Subject/Title: Adopt a resolution extending supplemental military pay and continuation of health benefits for Associate Engineer Frank Lideros, currently serving in the California Army National Guard, Operation Enduring Freedom

RECOMMENDATION
Approve a Resolution to extend supplemental salary and benefits for Frank Lideros (“Lideros”), up to February 28, 2007. Lideros was called to active military duty, beginning December 1, 2005. The extended supplemental salary and benefits will continue to alleviate financial hardships that Frank’s family would experience as the result of his call to active duty.

PREVIOUS ACTION
City Council approved Resolution 2005-251 on October 11, 2005 which provides supplemental salary and benefits for up to one year for regular employees called to active military duty. The supplemental benefits alleviate financial hardships that employees and their families experience when an employee is called to active duty.

BACKGROUND
Lideros was required to report to duty on November 30, 2005. On January 28, 2006, he was deployed to Afghanistan. Initially, staff understood that the 365-day period would begin on December 1, 2005 and end November 30, 2006. After Lideros’ departure, staff learned that his 365-day tour of duty would begin when he landed in Afghanistan in early February 2006.

Staff recommends extending supplemental salary and benefits for Lideros through the end of February 2007. He is expected to return to work on March 1, 2007. The extension would continue to provide salary to supplement Lideros’ military pay, as well as premium payments at the same rate the City pays for active employees toward health, dental and vision benefits. This will keep benefits intact for his family while he is serving in Afghanistan.

FISCAL IMPACT
The fiscal impact to extend the supplemental salary and benefits up to February 28, 2007 equals approximately $8,448.14. These funds are available in the approved 2005/06 and 2006/07 Operating Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD
TO EXTEND SUPPLEMENTAL MILITARY PAY AND CONTINUE HEALTH INSURANCE FOR FRANK LIDEROS WHILE SERVING ACTIVE MILITARY DUTY
UP TO FEBRUARY 28, 2007

WHEREAS, the City Council of the City of Brentwood recognizes the sacrifice and value of City employees that serve as Reservists in the various branches of the military; and

WHEREAS, at this time, Associate Engineer Frank Lideros, a regular City employee, is currently serving active military duty that commenced on November 30, 2005; and

WHEREAS, Lideros’ tour of duty will not end by November 30, 2006 as originally anticipated; and

WHEREAS, staff anticipates Lideros’ return to work on March 1, 2007; and

WHEREAS, providing extended supplemental salary and benefits is consistent with the City Council’s desire to alleviate financial hardships that employees and their families will experience as a result of the employee being ordered to active military service; and

WHEREAS, the City’s regular military pay policy complies with State and Federal laws in that it provides paid military leave to a maximum of thirty calendar days per fiscal year to employees who have been with the City for at least one year and who are ordered to active military service; and

WHEREAS, City Council of the City of Brentwood previously authorized:

1. The City will pay the difference between an employee’s base City salary and the employee’s military pay including all military allowances and/or premiums (if the base City salary exceeds the military pay); and
2. The City will pay the same contribution towards an employee’s health, dental, vision, and employee assistance program premiums for an employee called into active duty that it was paying at the time the employee was called up, excluding the cash allowance that may be received in-lieu of health benefits coverage; and
3. The City will continue the pay and benefits for employees remaining in active duty and called into such duty as outlined in this Resolution for up to twelve (12) months from the date that the employee has exhausted the 30 calendar days of pay provided per California Military and Veteran’s Code Section 395.03.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood:

The City will extend payment of items 1 and 2 listed above for Frank Lideros while serving active military duty up to and including February 28, 2007.
