Subject/Title: Set the date of October 24, 2006, to hear an appeal of the
Planning Commission’s decision denying an appeal filed by Bailey Neff of the
Community Development Department’s determination regarding the completeness
of an application for a tentative subdivision map (TSM 8446). The property
is located at 1060 Minnesota Avenue (APN 017-080-007).

Set October 24, 2006, as the hearing date to consider the appeal by Bailey
Neff in regard to the Planning Commission’s decision denying his appeal of
the Community Development Department’s determination regarding the
completeness of an application for a tentative subdivision map (TSM 8446).
• Planning Commission approval of a rezone (RZ 06-02) establishing
development standards for the property on June 6, 2006, with subsequent
adoption by City Council on June 27, 2006.
• City Council approval of a Residential Growth Management Allocation (RGMP
05-A2) for an 8-lot development on February 28, 2006.
At a hearing before the Planning Commission on October 3, 2006, the
Commission voted 5-0 to deny Mr. Neff’s appeal regarding staff’s
determination regarding the completeness of an application for a tentative
subdivision map (TSM 8446).
As required by Section 17.880.003.C, Bailey Neff has completed the required
application, submitted the required appeal fee, and provided a statement
setting forth the specific grounds for the appeal. It is a procedural
requirement that the City Council set the hearing. It is recommended that
the City Council set October 24, 2006, as the date for the hearing on the
appeal request. Mr. Neff requested that this hearing be held on October 24,
2006, consistent with a state law requirement. The City notified Mr. Neff
that his appeal would be agendized to be set for hearing and heard on
October 24, 2006, by notice dated October 13, 2006. The hearing is agendized
for later in the meeting tonight.
