CITY COUNCIL AGENDA ITEM NO. 18

Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD) for the extension of Garin Parkway, generally located south of Sunset Road, north of Jennifer Street, east of Brentwood Boulevard and west of the current City limits.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD) and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, for a portion of real property necessary for the extension of Garin Parkway northerly from Sand Creek Road, the project is identified as APN 016-190-008, generally located south of Sunset Road, north of Jennifer Street, east of Brentwood Boulevard and west of the current City limits.

PREVIOUS ACTION
On July 19, 2005, by Resolution No. 05-45, Planning Commission of the City of Brentwood approved the Barrington Project, Tentative Subdivision Map No. 8548, which included Conditions of Approval Item No. 6, requiring the extension of Garin Parkway from the southerly project boundary to Sunset Road.

On September 13, 2005, by Resolution No. 2005-226, City Council certified the Environmental Impact Report and adopted the accompanying Mitigation Monitoring Plan and approved Tentative Subdivision Map No. 8548. The 2006/07 – 2010/11 Capital Improvement Program (CIP) includes the Garin Parkway Improvements Phase II, as part of Developer Improvements.

BACKGROUND
The acceptance of the Grant of Easement from EBMUD for the extension of Garin Parkway is critical to complete the missing link from Jennifer Street to Sunset Road. The portion between Sycamore Avenue and Jennifer Street has already been constructed by Signature Properties. When this project is complete it will improve north to south traffic flow and safety. It will also provide another access to Sunset Industrial Complex and the Sports Park.

The Grant of Easement will allow the Developer to construct roadway and utility improvements over the EBMUD Aqueduct for the extension of Garin Parkway to Sunset Road. Additionally, this will allow the City to maintain and repair these improvements upon acceptance.

The project will consist of constructing approximately 3,965 linear feet of a 76-foot wide collector street with and 18-foot parkway on each side of the street. The utility lines, 16”, 30” and 72” water, 15” sanitary sewer, 18” and 24” storm drain lines have been installed as a part of Subdivision No. 8548, and will be completed with this phase. This project will also include the construction of a concrete slab over the EBMUD right-of-way.

FISCAL IMPACT
The project will be constructed by the Developer as a condition of approval. However, being offsite, it will be paid for by Roadway Facility Fees. This project will increase pavement management. Annual operating and maintenance for roadway and utility work is estimated to be $1,850.00.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A GRANT OF EASEMENT WITH EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD) AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, FOR A PORTION OF REAL PROPERTY NECESSARY FOR THE GARIN PARKWAY EXTENSION PROJECT IDENTIFIED AS APN 016-190-008, GENERALLY LOCATED SOUTH OF SUNSET ROAD, NORTH OF JENNIFER STREET, EAST OF BRENTWOOD BOULEVARD AND WEST OF THE CURRENT CITY LIMITS.

WHEREAS, a portion of real property identified as APN 016-190-008, generally located south of Sunset Road, north of Jennifer Street, east of Brentwood Boulevard and west of the current City limits is required to complete the missing link to extend Garin Parkway from Jennifer Street to Sunset Road; and

WHEREAS, the Grant of Easement between the City of Brentwood and East Bay Municipal Utility District (EBMUD) has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD) and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, for a portion of real property necessary for the Garin Parkway Improvements Phase II, identified as APN 016-190-008, generally located south of Sunset Road, north of Jennifer Street, east of east of Brentwood Boulevard and west of the current City limits.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 10th day of October 2006 by the following vote:
