RECOMMENDATION
Adopt a Resolution authorizing the submittal of a grant application in the amount of $612,000 to the Metropolitan Transportation Commission (MTC) for the 2006/07 Transportation for Livable Communities (TLC) Program, for funding of the Sand Creek Road Widening – UPRR to O’Hara Avenue, CIP Project No. 336-31680.

BACKGROUND
The purpose of the TLC program is to encourage transit-oriented development and bicycle-and pedestrian-friendly livable communities design principles in development projects. The minimum project cost for eligibility is $300,000 and the maximum is $1,000,000 for this TLC grant program. CIP projects eligible for funding include:

 Bicycle and pedestrian paths and bridges;
 On-street bike lanes;
 Pedestrian plazas;
 Pedestrian street crossings;
 Streetscaping such as median landscaping, street trees, lighting, furniture;
 Traffic calming design features such as pedestrian bulb-outs or transit bulbs;
 Transit stop amenities; way-finding signage; and
 Gateway features.

City staff has reviewed future Capital Improvement Program Projects (CIP) and has determined that the Sand Creek Road Widening-UPRR to O’Hara Avenue project has the best chance of receiving TLC grant funding. Improvements will remedy the disconnect in bicycle and pedestrian circulation between two main arterial streets and create better access for pedestrians/bicycles to the downtown core area. These improvements are consistent with the City’s “Parks and Trails Master Plan.” Presently there is no trail/sidewalk on the south side of Sand Creek Road from the railroad tracks as well as no existing pedestrian/bicycle path on O’Hara Avenue from Sand Creek Road to the existing commercial business, approximately 300 feet north of the Second Street/O’Hara Avenue intersection.

FISCAL IMPACT
The TLC program will reimburse up to 88.53% of project costs and requires a minimum 11.47% match from local funds. The matching funds from the City, in the amount of approximately $153,000, are budgeted in CIP Project No. 336-31680, which was adopted as part of the 2006/07 – 2010/11 Capital Improvement Program.

Currently, the pedestrian/bicycle path on O’Hara Avenue is outside the scope of work for the existing Sand Creek Widening-UPRR to O’Hara Avenue project. However, if the grant is awarded, staff will return to City Council with an amended budget sheet for CIP Project No. 336-31680 to reflect both the funding from the TLC program and the work on O’Hara Avenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE SUBMITTAL OF A GRANT APPLICATION IN THE AMOUNT OF $612,000 TO THE METROPOLITAN TRANSPORTATION COMMISSION (MTC) FOR THE 2006/07 TRANSPORTATION FOR LIVABLE COMMUNITIES (TLC) PROGRAM, FOR FUNDING OF THE SAND CREEK ROAD WIDENING – UPRR TO O’HARA AVENUE, CIP PROJECT NO. 336-31680.

WHEREAS, the purpose of the TLC program is to encourage transit-oriented development and bicycle-and pedestrian-friendly livable communities design principles in development projects; and

WHEREAS, City staff has reviewed future Capital Improvement Program Projects (CIP) and has determined that the Sand Creek Road Widening-UPRR to O’Hara Avenue project has the best chance of receiving TLC grant funding; and

WHEREAS, improvements will remedy the disconnect in bicycle and pedestrian circulation between two main arterial streets and create better access for pedestrians/bicycles to the downtown core area; and

WHEREAS, the TLC project is a highly competitive program intended to improve and enhance the safety of pedestrian and bicycle facilities and related infrastructure; and

WHEREAS, the TLC application contains assurances that the applicant must comply with, including a minimum of a 11.47% project cost match; and

WHEREAS, the federal funding through the TLC program is fixed at the program amount and any additional cost must be paid by the City; and

WHEREAS, funds from MTC must be obligated by June 30, 2009 or this project will be removed from the TLC program.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby:

1. Authorize the submittal of a grant application in the amount of $612,000 to the Metropolitan Transportation Commission (MTC) for the 2006/07 Transportation for Livable Communities (TLC) Program, for funding of the Sand Creek Road Widening – UPRR to O’Hara Avenue, CIP Project No. 336-31680.
2. Authorize the City Manager to sign all necessary documents related to this grant.
3. Agree to fund a minimum of 11.47% of the estimated project cost.
