Subject/Title: Adopt Resolution approving a Memorandum of Understanding between the City and the Contra Costa Office of the Sheriff regarding the “Avoid the 25” program, and authorizing the Chief of Police to execute the Memorandum of Understanding.

RECOMMENDATION
Adopt Resolution approving a Memorandum of Understanding between the City and the Contra Costa Office of the Sheriff regarding the “Avoid the 25” program, and authorizing the Chief of Police to execute the Memorandum of Understanding.

BACKGROUND
In an effort to reduce alcohol related fatal and injury collisions, the Brentwood Police Department in conjunction with the Contra Costa Office of the Sheriff and other Contra Costa police departments will work cooperatively in the annual “Avoid the 25” campaign.

The “Avoid the 25” campaign is funded by a grant from the California Office of Traffic Safety. The grant is managed by the Contra Costa Office of the Sheriff who reimburses allied agencies from the grant for officer overtime related to the “Avoid the 25” project. The “Avoid the 25” project period is from February 1, 2006 to January 1, 2009. The Brentwood Police Department has participated in the “Avoid the 25” since the year 2000.

“Avoid the 25” related enforcement activities include Driving Under the Influence (DUI) Checkpoints, roving DUI patrols, DUI warrant service and DUI education. The dates of the program will include Memorial Day, Labor Day and the winter holiday season.

FISCAL IMPACT
The total amount of the grant is $291,284. In 2005 the Brentwood Police Department was reimbursed $11,524.37 for overtime related to the “Avoid the 25” project. It is estimated that the Brentwood Police Department will be reimbursed approximately $12,000.00 in overtime costs for their participation in the 2006 “Avoid the 25” project. Other than overtime, it is anticipated that the police department will not incur any additional costs related to the program. The estimated overtime has been budgeted in the approved 2006/2007 operating budget.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE CONTRA COSTA OFFICE OF THE SHERIFF REGARDING THE “AVOID THE 25” PROGRAM.


WHEREAS, the Brentwood Police Department desires to participate in the “Avoid the 25” program; and

WHEREAS, the Brentwood Police Department desires to work with other Contra Costa law enforcement agencies to help reduce alcohol related fatal and injury vehicle collisions; and

WHEREAS, the Brentwood Police Department will be reimbursed from the Contra Costa Office of the Sheriff for overtime accrued working “Avoid the 25” programs.


NOW, THEREFORE BE IT RESOLVED the City Council of the City of Brentwood that

1. The Memorandum of Understanding attached hereto as Exhibit A is hereby approved.
2. The Chief of Police is hereby authorized to execute the Memorandum of Understanding, subject to minor revisions approved by the City Attorney, and to take all actions necessary to implement the terms of the Memorandum of Understanding.
