Meeting Date: October 10, 2006

Subject/Title: Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc. for Bid Package #22 Sitework at the New Police Facility, CIP Project No. 337-31420 and City Data Center, CIP Project No. 337-37090 and direct the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc. for Bid Package #22 at the New Police Facility, CIP Project No. 337-31420 and City Data Center, CIP Project No. 337-37090, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On December 14, 2005, by Resolution No. 2004-280 City Council approved the contract documents and awarded the Construction Contract for the New Police Station (Group C), CIP Project No. 337-3142, and the New City Hall Data Center, CIP Project No. 337-3139 to Bay Cities Paving & Grading for Bid Package #22 Sitework in the amount of $1,011,000, plus a 10% contingency for a total amount of $1,112,100.00.

BACKGROUND
The New Police Facility project is a multi prime project which required several trades to work within the specified site, all by separate contracts, managed by staff as discussed with the task force during the project budgeting process. The attached Notice of Completion (NOC) reflects work completed by one of the trades per contractual obligations for this project. Melloni Construction completed the glazing work (glass canopy) for the New Police Facility. As a multi prime project, the work is completed in phases and staff recommends accepting the work performed by this trade as indicated in the attached NOC.

City Council has already accepted the work performed by Dean’s Acoustical Ceiling, Denham Contracting, Systems & Space, Pueblo Tile, BT Mancini, Concord Iron Works, Martinez Sheet Metal, Melloni Construction (Package #18 Casework), Pro-Fit Fire Services, Freas Plastering, Marina Mechanical, Metal Building Company, D&D Commercial Painting, Inc., Del Monte Electric Company, Inc., Legg, Inc., Melloni Construction (Package #9 Carpentry), Coast Building, Electronic Techologies Corporation, McKay Construction and Melloni Construction (Package #12 Glazing).

With City Council’s acceptance this evening, this will complete all the multi-prime contracts for these two projects.

FISCAL IMPACT
Total contract amount for the work performed by Bay Cities Paving & Grading for the New Police Facility and City Data Center is as follows:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY BAY CITIES PAVING & GRADING, INC. FOR BID PACKAGE #22, SITEWORK, FOR THE NEW POLICE FACILITY, CIP PROJECT NO. 337-31420 AND CITY DATA CENTER, CIP PROJECT NO. 337-37090 AND DIRECT THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, the New Police Facility project was a multi prime project which required several trades to work within the specified site, all by separate contracts; and

WHEREAS, City Council has already accepted the work performed by Dean’s Acoustical Ceiling, Denham Contracting, Systems & Space, Pueblo Tile, BT Mancini, Concord Iron Works, Martinez Sheet Metal, Melloni Construction (Package #18 Casework), Pro-Fit Fire Services, Freas Plastering, Marina Mechanical, Metal Building Company, D&D Commercial Painting, Inc., Del Monte Electric Company, Inc., Legg, Inc., Melloni Construction (Package #9 Carpentry), Coast Building, Electronic Technologies Corporation, McKay Construction and Melloni Construction (Package #12 Glazing); and

WHEREAS, Bay Cities Paving & Grading, Inc. completed the sitework for the New Police Facility and City Data Center.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Bay Cities Paving & Grading, Inc., for Bid Package #22 Sitework, for the New Police Facility, CIP Project No. 337-31420 and City Data Center, CIP Project No. 337-37090, and the City Clerk is hereby directed to file the Notice of Completion with the County Recorder for this project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 10th day of October 2006 by the following vote:

NOTICE OF COMPLETION


NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 14th day of December 2004, enter into an agreement with Bay Cities Paving & Grading, Inc. for the sitework at the New Police Facility, CIP Project No. 337-31420 and City Data Center, CIP Project No. 337-37090, located at 9100 Brentwood Boulevard in Brentwood.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work for the New Police Facility, located at 9100 Brentwood Boulevard, Brentwood California 94513.

On the 10th day of Ocotber, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
