CITY COUNCIL AGENDA ITEM NO. 2

Meeting Date: October 10, 2006

Subject/Title: Set the public hearing date of October 24, 2006, to hear the appeal of a Planning Commission decision regarding a condition of approval pertaining to trash enclosure locations for the City Block project (DR 05-27), generally located on the vacant land at the southwest corner of the intersection of Griffith Lane and Balfour Road, west of the In-Shape City fitness center.

RECOMMENDATION
Set October 24, 2006, as the public hearing date to consider the appeals by Matt Ellison, K & E Properties, and Bonnie Keeton in regard to the City Block project.

PREVIOUS ACTION
On September 19, 2006, the Planning Commission considered an amendment to the design review (DR 05-27) for the City Block project, located on the vacant 4.47 acres just west of the In-Shape fitness facility. The applicant, Matt Ellison, had requested reconsideration of a condition of approval on the project regarding the relocation of the trash enclosures.

The Commission voted 4-0 (with Chairman Stirling abstaining) to place the trash enclosures within the parking lot of the project, with the exception that one of them could be located behind the buildings if a feasible location cannot be accommodated within the parking lot.

As required by Section 17.880.003.C, Matt Ellison has completed the required application, submitted the required appeal fee, and provided a statement setting forth the specific grounds for the appeal.

Subsequently, on September 28, 2006, a second appeal was filed by Bonnie Keeton who has also completed the required application, submitted the required appeal fee, and provided statements as required.

It is recommended that the City Council set October 24, 2006, as the date for the public hearing on the appeal requests.
