RECOMMENDATION
Consideration of a Resolution adopting a mitigated Negative Declaration for the Second Street / Pine Street Traffic Signal, CIP Project No. 336-31580.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Second Street / Pine Street Traffic Signal, CIP Project No. 336-3158.

On August 22, 2006, by Resolution No. 2006-192, City Council rejected the bid received for the Second Street/Pine Street Traffic Signal, CIP Project No. 336-31580 and directed staff to re-advertise, re-bid the project and return to City Council for award of the contract.

BACKGROUND
In an effort to improve pedestrian flow and safety for students crossing Second Street, as well as parents picking up and dropping off their students, it has become necessary to add a traffic signal and make improvements to the intersection and high school pick up / drop off areas. These improvements will increase the efficiency of the pick up / drop off areas and provide safety and congestion relief to motorists and bicyclists traveling through this intersection.

The City’s design consultant for this project, BKF Engineers Surveyors Planners prepared the mitigated Negative Declaration (MND) in accordance with the California Environmental Quality Act (CEQA), which requires state and local government agencies to consider the environmental consequences of proposed projects. The intent of the MND is to provide information concerning any potential environmental effects of the proposed project and to indicate possible ways to reduce or avoid potential significant effects.

Comments have been solicited from the public and affected regulatory agencies and no comments were received.

FISCAL IMPACT
This is an administrative function with no fiscal impact to the project.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE SECOND STREET / PINE STREET TRAFFIC SIGNAL, CIP PROJECT NO. 336-31580.

WHEREAS, on May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Second Street / Pine Street Traffic Signal, CIP Project No. 336-3158; and

WHEREAS, on August 22, 2006, by Resolution No. 2006-192, City Council rejected the bid received for the Second Street/Pine Street Traffic Signal, CIP Project No. 336-31580 and directed staff to re-advertise, re-bid the project and return to City Council for award of the contract.

WHEREAS, these improvements will increase the safety efficiency of the pick up / drop off areas and provide congestion relief to motorists and bicyclists traveling through this intersection; and

WHEREAS, a mitigated Negative Declaration was prepared, comments have been solicited from the public and affected regulatory agencies and no comments were received; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby adopt the mitigated Negative Declaration for the Second Street / Pine Street Traffic Signal, CIP Project No. 336-31580.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 26th day of September 2006 by the following vote:
