Subject/Title: Adoption of a negative declaration and approval of the Residential Design Guidelines prepared in accordance with action program 1.2.6 of the City’s General Plan Housing Element.

RECOMMENDATION
The Planning Commission and staff are recommending that the City Council adopt the negative declaration prepared for the project and approve the Residential Design Guidelines prepared in accordance with action program 1.2.6 of the City’s General Plan Housing Element.

PREVIOUS ACTION
In May of 2005, the City Council approved the update for the General Plan Housing Element. The Housing Element includes an action program (1.2.6) that calls for the preparation of residential design guidelines.

On June 13, 2005, the City Council approved a two-year action plan which identified the adoption of residential design guidelines as one of the work projects to be accomplished in association with the General Plan Housing Element to provide community-wide design standards for development of single-family and multi-family housing.

BACKGROUND
As mentioned above, the Housing Element includes an action program to adopt residential design guidelines. As part of the preparation for this document, on April 12, 2006, the Planning Commission held a workshop on a draft version in order to provide comments and feedback to staff. The issues raised at the workshop were incorporated into this final draft version which was unanimously approved by the Planning Commission by Resolution No. 06-90 at the September 5, 2006, meeting.

ANALYSIS
The proposed residential design guidelines represent the combined efforts of the Planning Commission, staff, Larry Cannon (the City’s consultant for this project), architectural firms which have been involved in past development projects with the City, and developers.

In order to meet the City’s fair share of the regional housing needs, many different housing product types will need to be provided which can accommodate varying densities of development. The proposed guidelines address all types of residential units, from single-family developments to multi-family developments, and provide distinct development goals for all product types. It is intended that any residential developer should be able to review the guidelines and submit an application to the City which would be consistent with the high-quality residential products that Brentwood has insisted upon in the past.

This document incorporates very minor revisions requested by the Planning Commission at their public hearing on September 5, 2006. Excerpts from the minutes of that meeting are attached for the City Council’s review.

The adoption of the guidelines will serve to improve the certainty of design expectations, minimize processing times for design review applications, and provide safe, sound, and attractive housing for the community.

CITY COUNCIL RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ADOPTING A NEGATIVE DECLARATION PREPARED FOR THE RESIDENTIAL DESIGN GUIDELINES, A PROJECT AFFECTING ALL RESIDENTIALLY-ZONED LAND WITHIN THE CITY OF BRENTWOOD.

WHEREAS, by Resolution No. 06-89 adopted on September 5, 2006, the Planning Commission of the City of Brentwood has recommended that the City Council approve a negative declaration for the proposed Residential Design Guidelines developed in accordance with action program 1.2.6 of the General Plan Housing Element; and

WHEREAS, the proposed project information was referred to various architectural firms, developers, and pertinent City departments for review and recommendations; and

WHEREAS, an initial study and negative declaration were prepared for this project in accordance with the California Environmental Quality Act (CEQA) and are considered a part of this review and approval process; and

WHEREAS, the negative declaration identified no significant environmental effects associated with the proposed project; and

WHEREAS, the availability of said environmental document for the minimum 20-day public review and comment period was begun on July 21, 2006, and ended on August 10, 2006, and no comments were received; and

WHEREAS, the City Council of the City of Brentwood considered this negative declaration at a public hearing at its regular meeting of September 26, 2006, and considered the staff report, all accompanying information, and public testimony received from interested parties.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby adopts the negative declaration for the Residential Design Guidelines, a project affecting all residentially-zoned land within the City of Brentwood.

CITY COUNCIL RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE RESIDENTIAL DESIGN GUIDELINES PREPARED IN ACCORDANCE WITH THE CITY OF BRENTWOOD GENERAL PLAN HOUSING ELEMENT ACTION PROGRAM 1.2.6. THIS PROJECT AFFECTS ALL RESIDENTIALLY-ZONED LAND WITHIN THE CITY OF BRENTWOOD.

WHEREAS, the City of Brentwood has established action program 1.2.6 within the General Plan Housing Element in order to adopt residential design guidelines to help the City continue to provide safe, sound, and attractive housing for residents and also to improve the certainty and minimize processing times for design review applications; and

WHEREAS, the Planning Commission of the City of Brentwood held a public hearing on September 5, 2006, reviewed the request for said adoption of the residential design guidelines and the corresponding staff report, considered all public testimony, studied the compatibility of the document with land uses, and voted unanimously to recommend City Council approval of the residential design guidelines with minor revisions by Resolution No. 06-90; and

WHEREAS, the residential design guidelines were revised as requested by the Planning Commission; and

WHEREAS, a Notice of Public Hearing was published in the Brentwood Press on September 15, 2006, in accordance with City policies and Government Code Section 65090; and

WHEREAS, the City Council of the City of Brentwood held a public hearing on September 26, 2006, reviewed the request for said adoption of the residential design guidelines and the corresponding staff report, considered all public testimony, and has studied the compatibility of the document with land uses; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood:

A. Hereby finds that:

1. The project is consistent with the existing General Plan Housing Element as it implements Action Program 1.2.6 by expressing the housing design features the City would like to encourage.

2. The project will create guidelines for high-quality residential design as it encourages specific architectural, project design and site development features for superior residential development.

3. The project will create guidelines to help the City continue to provide safe, sound, and attractive housing.

4. The project will improve certainty and minimize processing times for design review applications as it will establish specific criteria for residential developments thereby resulting in applications that can move quickly from staff review to Planning Commission action.

B. Hereby adopts the Residential Design Guidelines as reflected in Exhibit A attached to and made a part of this resolution.
