CONCERNING A CLOSED SESSION BEFORE THE
CITY OF BRENTWOOD REDEVELOPMENT AGENCY

TO: Honorable Chair and Brentwood Redevelopment Agency Board

FROM: Damien B. Brower, General Counsel

SUBJECT: Closed Session – Real Property [Gov’t. Code §54956.8]

Conference with Real Property Negotiators

Property: 3740 Walnut Boulevard, APN 012-170-006
Approximate size: 2.1560 acres

Negotiating Party: Henry Dill (representative for the Garin Family)

City Negotiators: Gina Rozenski/Howard Sword

Under Negotiation: Price and terms of payment

A closed session will be held on September 12, 2006, for the purpose of giving instructions to your negotiator regarding the price and terms of payment for the purchase, sale, exchange or lease of real property. [Gov’t. Code §54956.8]

If the Agency Board renders an agreement final, they shall report that approval and the substance of the agreement in open session at the public meeting during which the closed session is held. [Gov’t Code §54957.1(a)(1)(A)]

If final approval rests with the other party to the negotiations, the Agency shall disclose the fact of that approval and the substance of the agreement upon inquiry by any person, as soon as the other party or its agent has informed the Agency of its approval. [Gov’t. Code §54957.1(i)(a)(1)(B)]
