Subject/Title: Adopt Resolutions approving the Contract Documents, awarding the Construction Contracts and authorizing the City Manager to execute said Contracts for the 118 Oak Street Remodel, CIP Project No. 337-37130 for (1) Bid Package #3 – Metal Stud and Gypsum to Denham Contracting, Inc. in the amount of $57,909, for (2) Bid Package #5 – Plumbing to Martinez Sheet Metal, Inc., in the amount of $46,232, and for (3) Bid Package #11 – Casework to Sierra Cabinet & Millwork, Inc. in the amount of $56,564, plus 10% contingencies.

RECOMMENDATION
Adopt Resolutions approving the Contract Documents, awarding the Construction Contracts and authorizing the City Manager to execute said Contracts for the 118 Oak Street Remodel, CIP Project No. 337-37130 for (1) Bid Package #3 – Metal Stud and Gypsum to Denham Contracting, Inc. in the amount of $57,909, for (2) Bid Package #5 – Plumbing to Martinez Sheet Metal, Inc., in the amount of $46,232, and for (3) Bid Package #11 – Casework to Sierra Cabinet & Millwork, Inc. in the amount of $56,564, plus 10% contingencies.

PREVIOUS ACTIONS
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the 118 Oak Street Remodel, CIP Project No. 337-37130.

BACKGROUND
The improvements to 118 Oak Street will produce a tenant space that has few stationary walls, is extremely flexible and is able to accommodate a wide variety of future uses. Improvements include handicapped accessible restroom facilities, a conference room and access to adjoining City facilities. Completion of these improvements will provide temporary office space for Community Development Department Staff. This Flexible space will allow for the return of the Community Development Building Inspectors from the Tech Center, freeing rentable City space with the potential of bringing additional revenue to the City.

The 118 Oak Street Building Improvements will be constructed as a multi prime project which allows staff to better control the work and costs associated with construction. The City requested informal bids for the construction of the multi prime project on August 10, 2006 and bids were opened on August 30, 2006.

Bid Package #3 – Metal Stud and Gypsum, received a total of two bids which are listed below.
Denham Contacting $57,909
Pace Drywall $76,400
Staff recommends the award of the construction contract for the Bid Package #3 – Metal Stud and Gypsum to Denham Contacting in the amount of $57,909, plus a 10% contingency of $5,790.90, for a total amount of $63,699.90.

Bid Package #5 – Plumbing, received a total of one valid bid which is listed below.
Martinez Sheet Metal, Inc. $46,232

Staff recommends the award of the construction contract for Bid Package #5 – Plumbing to Martinez Sheet Metal, Inc. in the amount of $46,232, plus a 10% contingency of $4,623.20, for a total amount of $50,855.20.

Bid Package #11 – Casework, received a total of one bid which is listed below.
Sierra Cabinet & Millwork, Inc. $56,564

Staff recommends the award of the construction contract for Bid Package #11 – Casework to Sierra Cabinet & Millwork, Inc. in the amount of $56,564, plus a 10% contingency of $5,656.40, for a total amount of $62,220.40.

FISCAL IMPACT
The funds associated for this work will be paid through facility fees, as part of CIP Project 337-37130, which are included in the City’s adopted 2006/07 – 2010/11 Capital Improvement Program.

IN THE AMOUNT OF $57,909, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $63,699.90.

WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the 118 Oak Street Remodel, CIP Project No. 337-37130; and

WHEREAS, the improvements to 118 Oak Street will produce a tenant space that has few stationary walls, is extremely flexible and is able to accommodate a wide variety of future uses; and

WHEREAS, the 118 Oak Street Building Improvements will be constructed as a multi prime project which allows staff to better control the work and costs associated with construction; and

WHEREAS, the City requested informal bids for the construction of the multi prime project on August 10, 2006 and bids were opened on August 30, 2006.

WHEREAS, a total of two bids were received for Bid Package #3 – Metal Stud and Gypsum with the lowest responsive responsible bid being from Denham Contracting, Inc.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Contract Documents, award the Construction Contract and authorizes the City Manager to execute said Contract for the 118 Oak Street Remodel, CIP Project No. 337-37130 for Bid Package #3 – Metal Stud and Gypsum to Denham Contracting, Inc. in the amount of $57,909, plus a 10% contingency, for a total amount of $63,699.90.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of September 2006 by the following vote:
