RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute Program Supplement Agreement No. M002 Rev. 2 to Administering Agency-State Agreement No. 04-5300 for reimbursement of construction costs for the Walnut Boulevard Widening Project, CIP Project No. 336-30560.

PREVIOUS ACTION
On May 26, 1998, the City Council adopted Resolution No. 98-83 approving an updated Master Agreement with the State of California, Administering Agency-State Agreement for Federal Aid Projects, 04-5300.

On March 13, 2001, City Council adopted Resolution No. 2249 authorizing the City Manager to execute Program Supplement Agreement No. M002 Rev. 2 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening Project, then CIP Project No. 336-3056.

On October 28, 2003, City Council adopted Resolution No. 3019 authorizing the City Manager to execute Program Supplement Agreement No. M002 Rev. 1 for reimbursement of right of way costs for the Walnut Boulevard Widening Project, then CIP Project No. 336-3056.

On June 24, 2004, City Council approved a resolution authorizing the filing of an application for Cycle 2 TEA-21 Reauthorization funds through the Federal Surface Transportation Program for the Walnut Boulevard Widening Project, CIP 336-3056,

On April 29, 2005, City Council adopted Resolution 2005-93 , a Resolution of Local Support and Opinion of Legal Counsel which committing the necessary local match and stating the assurance of the City of Brentwood to complete the project

BACKGROUND
The City of Brentwood was awarded $1.3 million in federal funding from the Federal ISTEA program for the Walnut Boulevard Widening Project during fiscal year 1997/1998. Due to delays in the start of the project and unforeseen difficulties in securing Federal approval of the historic structures segment of the required environmental studies, the project could not meet the deadline for funding. Rather than having those funds revert back to the State staff subsequently prepared an amendment to the Transportation Improvement Program (TIP) to transfer this amount into the Brentwood Boulevard Widening Project, CIP 336-3054 leaving $300,000 in grant funds for preliminary engineering for Walnut Boulevard Widening.

The first opportunity for additional funding for this project was from the Surface Transportation Program (STP) in May 2004 and staff submitted an application for the maximum amount of $600,000. The Contra Costa Transportation Authority (CCTA) received a total of 20 applications totaling approximately $10.88 million in requests and only 12 were awarded due to limited funds. The City of Brentwood was not awarded at this time.

In February 2005 the Metropolitan Transportation Commission (MTC) informed CCTA staff that an additional $2.8 million was available for pavement overlay projects in Contra Costa. CCTA used the ranked list of projects that was the outcome of the May 2004 call for projects and The cities of Lafayette, San Ramon, Brentwood and Contra Costa County were proposed to be funded with the additional $2.8 million. Funding for construction had to be obligated by April 1, 2006 which meant that the right of way phase had to be completed and certified by Caltrans, the design completed and a DBE program for FY 05/06 in effect.

As required by the STP Program guidelines, a Resolution of Local Support and Opinion of Legal Counsel was adopted on April 25, 2005 to again authorize the application, commit the necessary local match and stating the assurance of the City of Brentwood to complete the project. Subsequently, MTC approved the TIP in June 2005 and FHWA approved it in July 2005. Right of way acquisition activities for the ten properties involved in the projects were complete in December 2005 and certification was approved by Caltrans and FHWA in March 2006. Staff immediately submitted a request for authorization for construction to Caltrans and met the deadline of April 1st, 2006 to obligate funds for the project.

In order to claim reimbursement for construction and construction engineering activities for this project, Program Supplement Agreement No. M002 Rev. 2, which is specific to the Walnut Boulevard Widening Project, must be approved and executed by the City and Caltrans.

FISCAL IMPACT
The City has been awarded $600,000 from the Surface Transportation Program and the required match of $68,820 is available from Facility Fees which were budgeted for the Walnut Boulevard Widening project, CIP 336-30560, in the 2006/07 – 2010/11 Capital Improvement Program Budget. Annual maintenance costs for the project are estimated to be $10,500.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. M002 REV. 2 TO THE MASTER ADMINISTERING AGENCY-STATE AGREEMENT NO. 04-5300 FOR THE WALNUT BOULEVARD WIDENING PROJECT, CIP PROJECT NO. 336-30560.

WHEREAS, Master Administering Agency-State Agreement 04-5300 for federal-aid projects was approved by the City of Brentwood on May 26, 1998; and

WHEREAS, the City of Brentwood is eligible to receive Federal funding for certain transportation projects through the California Department of Transportation (Caltrans); and

WHEREAS, Master Agreements and Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements need to be executed with Caltrans before such funds can be claimed; and

WHEREAS, the City may apply for reimbursement of eligible costs, upon approval by Caltrans.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood:

1. Approves Program Supplement Agreement No. M002 Rev. 2 to Master Administering Agency-State Agreement No. 04-5300 for the Walnut Boulevard Widening Project, CIP 336-30560.

2. Authorizes and directs the City Manager or her designee to execute and submit all documents which may be required for the completion of the project construction.
