Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Design Reimbursement Agreement with Chevron Pipeline Company in an amount of $75,900, plus a 10% contingency, for a total amount of $83,490, for the relocation of their existing 8” petroleum pipeline to facilitate the Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Design Reimbursement Agreement with Chevron Pipeline Company in an amount of $75,900, plus a 10% contingency, for a total amount of $83,490, for the relocation of their existing 8” petroleum pipeline to facilitate the Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134.

PREVIOUS ACTION
On December 9, 2003, City Council certified the Environmental Impact Report for the Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134.

On April 12, 2005, by Resolution No. 2005-75, City Council authorized the City Manager to execute a contract and related documents with Biggs Cardosa Associates, Inc. to provide Design Services for the Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134, in an amount of $1,315,000, plus a 10% contingency and amended the CIP Budget Sheet.

On May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Lone Tree Way – Union Pacific Undercrossing.

BACKGROUND
The attached contract is for Chevron Pipeline Company to relocate their existing 8” petroleum pipeline along the Union Pacific Railroad Crossing at Lone Tree Way. This relocation is necessitated by the construction of the Lone Tree Way – Union Pacific Undercrossing.

The next phase of the Lone Tree – Union Pacific Undercrossing is to relocate the gas and petroleum pipelines owned by PG & E, Chevron, and Kinder Morgan that are generally located along the Union Pacific Railroad (UPRR) right-of-way. These utilities must be relocated since the new roadway will depress over 20 feet deep from the existing grade at the UPRR crossing and the existing pipelines are only approximately five feet deep at this location.

Once this contract for design is approved and executed, Chevron Pipeline Company will commence with the necessary design to relocate their facility to not interfere with the future roadway undercrossing. Once the design is complete, a separate contract/agreement will be presented to the City Council for construction costs to relocate their facility.

FISCAL IMPACT
The funds for this work will be paid through facility fees, which are included in the existing budget as approved in the 2006/07 – 2010/11 Capital Improvement Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A DESIGN REIMBURSEMENT AGREEMENT WITH CHEVRON PIPELINE COMPANY IN AN AMOUNT OF $75,900, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $83,490, FOR THE RELOCATION OF THEIR EXISTING 8” PETROLEUM PIPELINE TO FACILITATE THE LONE TREE WAY – UNION PACIFIC UNDERCROSSING, CIP PROJECT NO. 336-3134.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Design Reimbursement Agreement with Chevron Pipeline Company in an amount of $75,900, plus a 10% contingency, for a total amount of $83,490, for the relocation of their existing 8” petroleum pipeline to facilitate the Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134.
