CITY COUNCIL AGENDA ITEM NO. 10

Meeting Date: September 12, 2006

Subject/Title: Adopt a Resolution accepting City Maintained Landscape Improvements on American Avenue adjacent to Heritage High School which includes the median and the roadway frontage between the curb and sidewalk and releasing the associated security bonds for these improvements.

RECOMMENDATION
Adopt a Resolution accepting all landscaped public improvements for maintenance along the American Avenue/Heritage High School median and roadway frontage and releasing the associated security bonds for these improvements.

PREVIOUS ACTION
None.

BACKGROUND
The Liberty Union High School District (LUHSD) hired Lathrop Construction Company to complete all on and off-site improvements associated with the construction of the new Heritage High School. Within these improvements, landscaping was installed in the public right-of-way on American Avenue from Balfour Road up to the southern property of Heritage High School.

The Heritage High School development as shown on the improvement plans has installed approximately 17,166 square feet of landscaping and irrigation work. All public landscaping improvements required by the development of the high school have been constructed and inspected for conformance with the approved improvement plans.

The School District Contractor is presently working on punch list items for the remaining roadway improvements and this acceptance should be forthcoming by the end of the year. The School District has requested immediate acceptance of the landscaping improvements since they do not have the staff or expertise to continue to maintain the public landscaping.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $4,800 associated with necessary maintenance of this landscaping. Landscaping and Lighting Assessment District (LLD) No. 99-03 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING LANDSCAPING IMPROVEMENTS FOR AMERICAN AVENUE ALONG THE HERITAGE HIGH SCHOOL ROADWAY FRONTAGE.

WHEREAS, the required public landscaping improvements have been completed and constructed in substantial conformance with the approved landscaping improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that:
1. The public improvements along the American Avenue median and roadway frontage as part of the Heritage High School construction are accepted for maintenance;
2. Bonds for the improvements will be released within sixty (60) days of the passage of this Resolution;
3. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
