Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Revocable License Agreement between the East Bay Municipal Utility District (EBMUD) and the City of Brentwood for a sanitary sewer crossing, located south of Sunset Road and Elkins Way.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a revocable license agreement between the East Bay Municipal Utility District (EBMUD) and the City of Brentwood for a sanitary sewer crossing.

PREVIOUS ACTION
None.

BACKGROUND
As part of the subdivision improvements, Standard Pacific Homes (Subdivision No. 8548 Stolich Property), is conditioned to install a sanitary sewer system which requires crossing the East Bay Municipal Utility District rights-of-way in order to tie-in to the public sewer system on Sunset Road. Standard Pacific Homes submitted a permit application to East Bay Municipal Utility District (EBMUD) in order to comply with their condition of approval. EBMUD submitted the necessary documentation to the City of Brentwood in order to move forward with the work, including the attached agreement. There is a one time licensing fee of $2,000 payable to EBMUD that is being paid by the Developer. The contractor that will be hired by Standard Pacific Homes to construct the improvements will file a permit on behalf of their company with EBMUD and file the necessary insurance.

FISCAL IMPACT
There is no fiscal impact associated with this action, the required one time licensing fee will be paid by the Developer.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A REVOCABLE LICENSE AGREEMENT BETWEEN THE EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD) AND THE CITY OF BRENTWOOD FOR A SANITARY SEWER CROSSING, LOCATED SOUTH OF SUNSET ROAD AND ELKINS WAY.

WHEREAS, as part of the subdivision improvements, Standard Pacific Homes (Subdivision No. 8548), is conditioned to install sanitary sewer system which requires crossing the East Bay Municipal Utility District rights-of-way in order to tie-in to the Public Sewer System on Sunset Road; and

WHEREAS, Standard Pacific Homes submitted a permit to East Bay Municipal Utility District in order to comply with their condition; and

WHEREAS, EBMUD submitted the necessary documentation to the City of Brentwood in order to move forward with the work, including the attached agreement, and a one time licensing fee payable to EBMUD not to exceed $2,000.

WHEREAS, the contractor that will be hired by Standard Pacific Homes to construct the improvements will file a permit on behalf of their company with EBMUD and file the necessary insurance.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute a revocable license agreement between the East Bay Municipal Utility District (EBMUD) and the City of Brentwood and that the one time licensing fee in amount not to exceed $2,000 for the sanitary sewer crossing will be paid by the Developer.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 22nd day of August 2006 by the following vote:
