Subject/Title: Authorize any member or members of the City Council to submit an argument in favor of the Measure related to the term of office for Mayor for the November 7, 2006, election.

RECOMMENDATION

Authorize any member or members of the City Council to submit an argument in favor of the Measure related to the term of office for Mayor for the November 7, 2006, election.

PREVIOUS ACTION

At the City Council meeting of May 23, 2006, the City Council adopted Resolution 2006-106, calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 7, 2006, and submitting to the voters a question related to the term of office for the Mayor’s position.

BACKGROUND

California Elections Code Section 9282 permits the legislative body, or any member or members of the legislative body authorized by that body, or any individual voter who is eligible to vote on the measure, or bona fide association of citizens or any combination of voters and associations, to file an argument for or against any measure.

In accordance with California Elections Code Section 9282, the City Council must determine whether it wishes to exercise its rights to author and sign ballot arguments regarding the ballot measure related to the term of office for the Mayor’s position.

The City Council as a body may exercise its rights to author and sign ballot arguments; action should be taken to appoint members of the Council to write the arguments on behalf of the Council. If the Council does not wish to author and sign ballot arguments, the Council may determine whether any member or members of the City Council wish to author and sign a written ballot argument for or against the measures and they will be authorized to use their titles as City Council Members.

Direct arguments must be filed in the City Clerk’s Office by Monday, August 14, 2006 at 5:00 p.m. If both arguments in favor and against are filed, rebuttal arguments may be prepared. Rebuttal arguments must be filed in the City Clerk’s Office by Friday, August 21, 2006, at 5:00 p.m.

FISCAL IMPACT

There is no fiscal impact associated with this item, the cost of adding the Measure was included in the Fiscal Year 2006/07 budget.
