Subject/Title: Temporary Closure of Dynasty Drive from Neroly Road to Alexander Way.

RECOMMENDATION
Adopt a Resolution authorizing the City Engineer to temporarily close Dynasty Drive from Neroly Road to Alexander Way from approximately August 15, 2006 to November 15, 2006, for Pulte Homes to facilitate necessary improvements to Neroly Road and authorize the City Engineer to extend the closure beyond November 15, 2006, should deemed necessary to complete these improvements.

BACKGROUND
As part of their development in the City of Oakley, north of Neroly Road, Pulte Homes will be improving and realigning Neroly Road. They have requested the closure of Neroly Road from the City Oakley from Brown Road to the intersection of Empire Avenue and Neroly Road (see attached map, Neroly Road Detour Plan), from August 15, 2006 to approximately November 15, 2006. Pulte Homes is anticipating that this closure will expedite these improvements by three to four weeks and limit the inconvenience to residents and motorists. Because of this closure, it becomes necessary for the City of Brentwood to close Dynasty Drive from Neroly Road to Alexander Way, as residents will not be able to access Neroly Road from the Rose Garden development. Pulte Homes in conjunction with the City of Oakley will provide a detour that will reroute residents to O’Hara Avenue during this closure (see attached map, Dynasty Drive Detour Plan). It will also be the City of Oakley and Pulte Homes responsibility to notify all residents in this area prior to this closure.

City of Oakley staff is in support of this closure; however, the formal request will be going to their City Council meeting of August 14th for approval. Should their City Council not approve Pulte’s request for the Neroly Road closure, it will no longer be necessary for the City of Brentwood to close Dynasty Drive and this request will become null and void.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY ENGINEER TO TEMPORARILY CLOSE DYNASTY DRIVE FROM NEROLY ROAD TO ALEXANDER WAY FROM APPROXIMATELY AUGUST 15, 2006 TO NOVEMBER 15, 2006, FOR PULTE HOMES TO FACILITATE NECESSARY IMPROVEMENTS TO NEROLY ROAD AND AUTHORIZE THE CITY ENGINEER TO EXTEND THE CLOSURE BEYOND NOVEMBER 15, 2006, SHOULD DEEMED NECESSARY TO COMPLETE THESE IMPROVEMENTS.

WHEREAS, Pulte Homes, as part of their development, is making improvements to Neroly Road; and

WHEREAS, Pulte Homes has requested the closure of Neroly Road from Brown Road to the intersection of Empire Avenue and Neroly Road from August 15, 2006 to November 15, 2006; and

WHEREAS, the City of Oakley is in agreement with this request; and

WHEREAS, this closure, makes it necessary for the City of Brentwood to close Dynasty Drive from Neroly Road to Alexander Way; and

WHEREAS, Pulte Homes will notify and provide a detour that will reroute residents to O’Hara Avenue during this closure; and

WHEREAS, per Brentwood Municipal Code Section 10.04.120, City Council is authorized to approve a full street closure for construction; and

WHEREAS, if the City of Oakley’s City Council does not approve the closure of Neroly Road at their meeting of August 14, 2006, it will no longer be necessary for the City of Brentwood to close Dynasty Drive.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Engineer to temporarily close Dynasty Drive from Neroly Road to Alexander Way from approximately August 15, 2006 to November 15, 2006, for Pulte Homes to facilitate necessary improvements to Neroly Road and authorize the City Engineer to extend the closure beyond November 15, 2006, should deemed necessary to complete these improvements.
