Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Construction Contract and necessary documents for the Communication Tower located at the Police Department, 9100 Brentwood Blvd., CIP Project No. 337-3708 to L.D. Strobel Co., Inc., in the amount of $374,399, plus a 10% contingency, for a total amount of $411,838.90.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Construction Contract and necessary documents for the Communication Tower located at the Police Department, 9100 Brentwood Blvd., CIP Project No. 337-3708 to L.D. Strobel Co., Inc., in the amount of $374,399, plus a 10% contingency, for a total amount of $411,838.90.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-126, City Council adopted the 2006/07 – 20010/11 Capital Improvement Program.

BACKGROUND
The tri-pod tower is a vital piece of infrastructure to support the wireless data and voice communication needs for the City of Brentwood. The Communication Tower will house multiple antennas that will support remote City facilities such as the Aquatic Park, Veteran’s Park, Technology Center, and the Public Works facilities. The Police Department will also benefit from the Communication Tower by addressing the wireless needs for a possible future dispatch center.

Staff advertised the project for construction beginning June 29, 2006 and bids were opened on Thursday, July 27, 2006. A total of 2 bids were received, the bids were reviewed and the lowest responsive, responsible bid was received from L.D. Strobel Co., Inc.

The two bids were:

L.D. Strobel Co., Inc. $374,399
Cal Inc. $596,000

Staff recommends the award of the Construction Contract for the Communication Tower to L.D. Strobel Co., Inc. in the amount of $374,399, plus a 10% contingency, for a total amount of $411,838.90.

FISCAL IMPACT
The funds associated with this work at the cost of $411,838.90 has been budgeted in the adopted 2006/07 – 20010/11 Capital Improvement Program and the budget contains funds for the construction of the Communication Tower, CIP Project No. 337-3708.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT AND NECESSARY DOCUMENTS FOR THE COMMUNICATION TOWER LOCATED AT THE POLICE DEPARTMENT, 9100 BRENTWOOD BLVD., CIP PROJECT NO. 337-3708 TO L.D. STROBEL CO., INC., IN THE AMOUNT OF $374,399, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $411,838.90

WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the 2006/07 – 20010/11 Capital Improvement Program; and

WHEREAS, the project was advertised beginning, June 29, 2006 and bids were opened on Thursday, July 27, 2006; and

WHEREAS, a total of two bids were received and the lowest responsive, responsible bid was received from L.D. Strobel Co., Inc., in the amount of $374,399.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Construction Contract and necessary documents for the Communication Tower located at the Police Department, 9100 Brentwood Blvd., CIP Project No. 337-3708 to L.D. Strobel Co., Inc., in the amount of $374,399, plus a 10% contingency, for a total amount of $411,838.90.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 8th day of August 2006 by the following vote:

AGREEMENT

COMMUNICATION TOWER
CIP PROJECT NO. 337-3708

THIS AGREEMENT FOR CONSTRUCTION is made and entered into this _____ day of ____________________, 2006 by and between the City of Brentwood (herein called City) and L.D. Strobel Co., Inc., a California corporation, a partnership or an individual (circle one) located at 1022 Shary Circle, Suite 9, (925) 686-3241, herein called Contractor.
The City and the Contractor agree as follows:

(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of THREE HUNDRED SEVENTY FOUR THOUSAND THREE HUNDRED AND NINETY-NINE DOLLARS ($374,399) to be paid in accordance with the Contract Documents.

(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.

(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor's Certificate Regarding Worker's Compensation, Certificate of Insurance and Endorsement (Worker's Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications (July 2002), City of Brentwood Standard Plans and Specifications (current version), Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.

CONTRACTORS ARE REQUIRED BY LAW TO BE LICENSED AND REGULATED BY THE CONTRACTORS’ STATE LICENSE BOARD WHICH HAS JURISDICTION TO INVESTIGATE COMPLAINTS AGAINST CONTRACTORS IF A COMPLAINT REGARDING A PATENT ACT OR OMISSION IS FILED WITHIN FOUR YEARS OF THE DATE OF THE ALLEGED VIOLATION. A COMPLAINT REGARDING A LATENT ACT OR OMISSION PERTAINING TO STRUCTURAL DEFECTS MUST BE FILED WITHIN 10 YEARS OF THE DATE OF THE ALLEGED VIOLATION. ANY QUESTIONS CONCERNING A CONTRACTOR MAY BE REFERRED TO THE REGISTRAR, CONTRACTORS’ STATE LICENSE BOARD, P.O. BOX 26000, SACRAMENTO, CALIFORNIA 95826.
