Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with Signature Properties for Slurry Seal and Signing and Striping Improvements on Balfour Road (Subdivision No. 8627) in the amount of $16,774.78, plus a 10% contingency, for a total amount of $18,452.26

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with Signature Properties for Slurry Seal and Signing and Striping Improvements on Balfour Road (Subdivision No. 8627) in the amount of $16,774.78, plus a 10% contingency, for a total amount of $18,452.26.

PREVIOUS ACTION
On April 12, 1994, City Council approved Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facility Improvements.

On May 6, 2003, Tentative Subdivision Map No.'s 8627 and 8633 were approved by Resolution No. 03-22 of the Planning Commission to change the land use mix for the commercial and high-density uses.

On April 20, 2004, Resolution No. 03-22 of the Planning Commission was amended to extend the Tentative Subdivision Map approvals one year.

On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Roadway Signing and Striping, CIP Project No. 336-3147.

BACKGROUND
Signature Properties originally constructed Balfour Road from Brentwood Boulevard to Garin Parkway with Subdivision No.’s 7798 and 7799. The conditions of approval for Subdivision No.’s 8627 and 8633 required additional widening in conjunction with the commercial and multi-family projects.

Signature Properties is required to grind existing striping, slurry seal and re-stripe Balfour Road from Brentwood Boulevard to Malaga Court. The City of Brentwood had requested that Signature Properties include the section of Balfour Road from Malaga Court to Garin Parkway when soliciting bids. The City of Brentwood requested the inclusion of this section in the interest of public safety to provide consistent lane striping between the signal at Brentwood Boulevard and the stop signs at Garin Parkway/Guthrie Lane. The section between Malaga Court and Garin Parkway would be the responsibility of the City of Brentwood.

Signature Properties included the above section with their bid request. Three bids were received and Signature Properties has contracted with the low bidders for both the slurry seal and the signing and striping. The section of road that is the City’s responsibility totals $16,774.78.

FISCAL IMPACT
The cost associated with the City’s portion of the construction is $16,774.78, plus a 10% contingency, for a total amount of $18,452.26. These funds would come from CIP Project No. 336-3147, Roadway Signing and Striping.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A REIMBURSEMENT AGREEMENT WITH SIGNATURE PROPERTIES FOR SLURRY SEAL AND SIGNING AND STRIPING IMPROVEMENTS ON BALFOUR ROAD (SUBDIVISION NO. 8627) IN THE AMOUNT OF $16,774.78, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $18,452.26

WHEREAS, on April 12, 1994, City Council approved Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facility Improvements; and

WHEREAS, on May 6, 2006, by Resolution No. 03-22, the Planning Commission approved Tentative Subdivision Map No.’s 8627 and 8633 changing the land use mix for the commercial and high-density uses; and

WHEREAS, on April 20, 2004, Planning Commission amended Resolution No. 03-22 to extend the Tentative Subdivision Map approvals for one year; and

WHEREAS, on May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the Roadway Signing and Striping, CIP Project No. 336-3147; and

WHEREAS, the City of Brentwood requested that bids solicited by Signature Properties include the portion of Balfour Road between Malaga Court and Garin Parkway/Guthrie Lane.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Reimbursement Agreement with Signature Properties for Slurry Seal and Signing and Striping Improvements on Balfour Road (Subdivision No. 8627) in the amount of $16,774.78, plus a 10% contingency, for a total amount of $18,452.26
