Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a construction contract and necessary documents for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 to Grade Tech, Inc. in the amount of $283,830.55, plus a 10% contingency, for a total amount of $312,213.61.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a construction contract and necessary documents for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 to Grade Tech, Inc. in the amount of $283,830.55, plus a 10% contingency, for a total amount of $312,213.61.

PREVIOUS ACTION
On September 27, 2005, by Resolution No. 2005-229, City Council approved a Reimbursement Agreement with the Liberty Union High School District in the amount of $108,300, for the American Avenue/Balfour Road Intersection Modifications and authorized the City Manager to execute the said agreement and amended the American Avenue Extension, CIP Project No. 336-3156 Budget Sheet.

On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP), which included the American Avenue Extension, CIP Project No. 336-3156.

BACKGROUND
City staff has been working toward modifying the existing improvements at the intersection of Balfour Road and American Avenue to increase traffic circulation due to the opening of the Adams Middle School this August. The first phase, Balfour Road dual left turn lanes onto American Avenue has been completed. The second phase, which is the award of this contract, is to create dual right turn lanes on American Avenue approaching Balfour Road. Both phases of this work will help traffic circulation at the intersection and to and from the High School and Middle School.

Staff advertised the project for construction beginning June 12, 2006 and bids were opened on Tuesday, July 11, 2006. One bid was received, which was from Grade Tech, Inc. After review of the bid proposal, staff recommends the award of the construction contract for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 in the amount of $283,830.55, plus a 10% contingency of $28,383.06, for a total amount of $312,213.61, to Grade Tech, Inc.

Even though there was only one bid and it was higher than the engineering estimate, the cost is still within the existing project budget. With the construction industry cost trend, it is staff’s opinion that re-bidding this job at this busy construction season may not guarantee a better bid. Staff has seen project costs continue to rise due to higher base material costs (steel, concrete, asphalt) as well as contractor availability at this time, and believes a delay in the project may only increase the total project cost. Further, these improvements are time sensitive with the opening of the new Adams Middle School in August. By approving this contract, the project can be completed before the rainy season this year.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2006/07 – 2010/11 Capital Improvement Program and the budget contains funds for the construction of the American Avenue Extension (Widening Phase), CIP Project No. 336-3156.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT AND NECESSARY DOCUMENTS FOR THE AMERICAN AVENUE EXTENSION (WIDENING PHASE), CIP PROJECT NO. 336-3156 TO GRADE TECH, INC. IN THE AMOUNT OF $283,830.55, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $312,213.61.

WHEREAS, on September 27, 2005, by Resolution No. 2005-229, City Council approved a Reimbursement Agreement with the Liberty Union High School District in the amount of $108,300, for the American Avenue/Balfour Road Intersection Modifications and authorized the City Manager to execute the said agreement and amended the American Avenue Extension, CIP Project No. 336-3156 Budget Sheet; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a construction contract and necessary documents for the American Avenue Extension (Widening Phase), CIP Project No. 336-3156 to Grade Tech, Inc. in the amount of $283,830.55, plus a 10% contingency, for a total amount of $312,213.61.
