RECOMMENDATION
Adopt a Resolution establishing a policy and procedure for granting priority water and sewer services to proposed developments that include affordable housing units.

PREVIOUS ACTION
On September 9, 2003, by Ordinance No. 756, City Council added Chapter 17.725 to the Brentwood Municipal Code by establishing an Affordable Housing Program.

On January 11, 2005, by Ordinance No. 790, City Council amended Chapter 17.725 of the Brentwood Municipal Code by revising the Affordable Housing Program.

BACKGROUND
In 2005, Senate Bill 1087 was passed which amended the Government Code Section relating to Affordable Housing. The specific Code Section, 65589.7, was amended to require public agencies and private entities providing water or sewer service to do the following:

1. Grant service priority to developments that include affordable housing units; and
2. Adopt written policies and procedures for the provision of water and sewer service to low income housing units.

The attached Resolution proposes the policy and procedure by which the City will comply with the Government Code as required. In summary, the procedure states:

1. Proposed developments that include housing units affordable to low income residents will receive water and sewer service priority.
2. Definition for “Affordable Unit.”
3. Findings by which the City may make exceptions for not providing priority service to affordable units.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ESTABLISHING A POLICY AND PROCEDURE FOR GRANTING PRIORITY WATER AND SEWER SERVICES TO PROPOSED DEVELOPMENTS THAT INCLUDE AFFORDABLE HOUSING UNITS.

WHEREAS, the State of California has declared that the availability of housing is of vital statewide importance, and the early attainment of decent housing and a suitable living environment for every Californian is a priority of the highest order; and

WHEREAS, the State of California has declared that local and state governments have a responsibility to use the powers vested in them to facilitate the improvement and development of housing to make adequate provision for the housing needs of all economic segments of the community; and

WHEREAS, to facilitate housing needs for all economic segments of the community, the City Council of the City of Brentwood has adopted Chapter 17.725 of the Brentwood Municipal Code (Affordable Housing Program); and

WHEREAS, per Section 65589.7 of the California Government Code, each public agency or private entity providing water or sewer services shall grant a priority for the provision of these services to proposed developments that include housing units affordable to lower income households.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood:

Section 1. To comply with Government Code Section 65589.7 the City Council hereby adopts a policy and procedure for prioritizing water and sewer services to low income housing developments, a copy of which is attached hereto as Exhibit “A”.

Section 2. This Resolution shall take effect immediately following its adoption.
