Subject/Title: Adopt a Resolution accepting Improvements for Signature
Properties Subdivision No. 8425, located south of Chestnut Street and west
of Garin Parkway.

Adopt a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Signature Properties Subdivision No.
8425, located south of Chestnut Street and west of Garin Parkway.
On August 3, 1999, by Resolution No. 99-31, Planning Commission approved
Tentative Subdivision Map No. 8221, with conditions.
On July 22, 2002, by Resolution No. 2622, City Council approved Final
Subdivision Map No. 8425, accepting improvement securities and approving a
Subdivision Improvement Agreement.
This subdivision, located west of Garin Parkway and south of Chestnut
Street, has been developed by Signature Properties and contains 56
single-family residential lots. All public improvements required by the
project’s conditions of approval have been constructed and inspected for
conformance with the approved improvement plans including sewer, water and
storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and
landscaping. As a part of the Garin Ranch Specific Plan, of which the
subdivision is included, Signature Properties widened Balfour Road and
Brentwood Boulevard, constructed Garin Parkway north of Balfour Road,
constructed major storm drainage improvements for the south east quadrant of
the City and widened Sellers Avenue, including with a non-potable water
distribution line, from Chestnut Street to Balfour Road. Signature
Properties has provided Maintenance Bonds to cover the twelve-month warranty
period for all improvements.
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities: 678
LF of 8” sewer lines, 746 LF of 8” waterline, 823 LF of 18” storm drain
line, 865 LF of 5’ wide sidewalk, 2,591 LF of pavement, 1,533 LF of curb and
gutter, 7 streetlights and 767 LF of fiber optic conduit.
When the Final Map was approved by the City Council, the right-of-way offers
of dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs in the
amount of approximately $9,400, associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 98-5 has been formed for this
subdivision and will be responsible for the street lighting and landscape

RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S
RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP;
ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION
MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR
SIGNATURE PROPERTIES SUBDIVISION NO. 8425, LOCATED SOUTH OF CHESTNUT STREET
AND WEST OF GARIN PARKWAY.
WHEREAS, on August 3, 1999, by Resolution No. 99-31, Planning Commission
approved Tentative Subdivision Map No. 8221, with conditions; and
WHEREAS, on July 22, 2002, by Resolution No. 2622, City Council approved
Final Subdivision Map No. 8425, accepting improvement securities and
approving a Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are hereby accepted for Subdivision No. 8425,
Signature Properties, for maintenance; and
1. All offers of dedication for rights-of-way, easements, abutter’s rights,
sub-surface mineral and water rights and parcels of land intended for public
use as shown on the final map are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and
workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within
sixty (60) days of the passage of this Resolution.
4. The City Council of the City of Brentwood directs the City Clerk to file
this Resolution with the Recorder of Contra Costa County.
