Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a purchase order for Road Spot wireless lighted crosswalk equipment from Spot Devices, Inc. in an amount of $56,321.39, plus a 10% contingency, for a total amount of $61,953.53, for the Bicycle and Pedestrian Safety Program, CIP Project No. 336-3157.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a purchase order for Road Spot wireless lighted crosswalk equipment from Spot Devices, Inc. in an amount of $56,321.39, plus a 10% contingency, for a total amount of $61,953.53, for the Bicycle and Pedestrian Safety Program, CIP Project No. 336-3157.

PREVIOUS ACTION
On May 23, 2006, by Resolution No. 2006-115, City Council adopted the City’s 2006/07 – 2010/11 Capital Improvement Program (CIP).

On September 13, 2005, by Resolution No. 2005-221, City Council authorized the City Manager to execute the Funding Agreement with the State of California Office of Traffic Safety for a safety grant in the amount not to exceed of $138,275.

BACKGROUND
The California Office of Traffic Safety (OTS) makes funds available to local government for the purposes of reducing vehicle, bicycle and pedestrian collisions and making public roadways safer. Funding is based upon the magnitude and severity of the problems identified, and availability of funds.

A “concept paper” was submitted by staff from the Public Works (Engineering Division) and Finance Departments requesting a grant in the amount of $138,275 in the Pedestrian and Bicycle Safety program area, due to the need shown by the OTS ranking. Of this grant, $56,321.39 will pay for the purchase of equipment and all appurtenances for in-pavement lighted crosswalks at five locations. The City of Brentwood must pay for the installation costs associated with the lighted crosswalks. This funding was authorized by City Council through CIP Project No. 336-3157.

Due to the specific nature of these devices, the City was able to obtain only two quotes: Spot Devices for $56,321.39 and Silicon Constellations for $63,867.50 (the attached quote was for six locations and recalculated for five locations).

The in-pavement crosswalk systems will be installed in the following locations:

• Dainty Avenue at Marsh Creek (east of the Dainty Center)
• Grant Street east of Fairview Avenue (crossing from Miwok Park to EBMUD trail on north side of Grant Street)
• Minnesota Avenue @ Sand Creek Crossing
• Minnesota Avenue @ Deer Creek Crossing

One additional location will be selected at a future date.

FISCAL IMPACT
100% of the amount shown on the attached cost proposal from Spot Devices, Inc. will be reimbursed to the City through the OTS Safety Grant agreement provisions. By purchasing all of the crosswalk equipment at one time, Spot Devices, Inc. is giving the City a reduction of 10% on the overall cost.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A PURCHASE ORDER FOR ROAD SPOT WIRELESS LIGHTED CROSSWALK EQUIPMENT FROM SPOT DEVICES, INC. IN AN AMOUNT OF $56,321.39, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $61,953.53, FOR THE BICYCLE AND PEDESTRIAN SAFETY PROGRAM, CIP PROJECT NO. 336-3157.

WHEREAS, the Office of Traffic Safety (OTS) administers a Federal Grant Program using Federal funds apportioned to California under the National Highway Safety Act and the Transportation Equity Act for the 21st Century (TEA-21) for programs designed to reduce deaths, injuries and economic losses resulting from traffic related collisions; and

WHEREAS, based on the concept paper submitted for the City of Brentwood Pedestrian and Bicycle Safety Program, OTS has approved funding for the project in the amount of $138,275, for the period from October 1, 2005 to December 31, 2007; and

WHEREAS, on September 13, 2005, by Resolution No. 2005-221, City Council authorized the City Manager to execute the Funding Agreement with the State of California Office of Traffic Safety for the Pedestrian and Bicycle Safety Grant in the amount of $138,275; and

WHEREAS, on September 27, 2005, by Resolution No. 2005-233, City Council approved CIP Project No. 336-3157, authorizing funding for the installation of in-pavement lighted crosswalk equipment purchased with grant funds; and

WHEREAS, the intent of the Pedestrian and Bicycle Safety Program is to reduce pedestrian and bicycle collisions with a combination of education, enforcement and engineering technology, with collision-tracking software and installation of in-pavement lighted crosswalks; and

WHEREAS, the grant allocates a reimbursable amount for the purchase of in-pavement lighted crosswalk equipment; and

WHEREAS, the City of Brentwood has received a price quote from Spot Devices, Inc. for the purchase of in-pavement lighted crosswalk equipment for five locations.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a purchase order for Road Spot wireless lighted crosswalk equipment from Spot Devices, Inc. in an amount of $56,321.39, plus a 10% contingency, for a total amount of $61,953.53, for the Bicycle and Pedestrian Safety Program, CIP Project No. 336-3157.
