REDEVELOPMENT AGENCY AGENDA ITEM NO. 2

Subject/Title: Adopt a Resolution approving and authorizing the Executive Director or her designee to execute a Grant Deed and such other documents as may be needed to convey real property on behalf of the Redevelopment Agency to the City of Brentwood, generally located at Gregory Lane.

RECOMMENDATION
Adopt a Resolution approving and authorizing the Executive Director or her designee to execute a Grant Deed and such other documents as may be needed to complete the transaction, hereby conveying real property on behalf of the Redevelopment Agency to the City of Brentwood, for real property identified as APN 018-160-017, generally located at Gregory Lane.

PREVIOUS ACTION
On January 26, 1993 by Resolution No. 93-1A, the Redevelopment Agency of the City of Brentwood authorized execution of an agreement between the Redevelopment Agency of the City of Brentwood and the Board of Supervisors of Contra Costa County to purchase tax-defaulted property, commonly known as Gregory Lane for $800.00.

On June 17, 1993, a Tax Deed was recorded transferring Gregory Lane to the Redevelopment Agency of the City of Brentwood.

BACKGROUND
Section 3791.3 of the Revenue and Taxation Code allows redevelopment agencies to purchase tax-defaulted property within the redevelopment project area from counties.

Gregory Lane was a privately owned parcel of land which was classified as tax-defaulted property by the County of Contra Costa. It was the intent of the Redevelopment Agency to make certain improvements on Gregory Lane which were completed in 1994. After the improvements, Gregory Lane became a City-maintained, public road. Therefore, the Agency would like to convey Gregory Lane to the City of Brentwood. This is a housekeeping item.

FISCAL IMPACT
No funds shall be paid by the City to the Agency for Gregory Lane.

RESOLUTION NO.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE EXECUTIVE DIRECTOR OR HER DESIGNEE TO EXECUTE A GRANT DEED FOR ROADWAY PURPOSES FOR GREGORY LANE, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY CONVEYING REAL PROPERTY ON BEHALF OF THE REDEVELOPMENT AGENCY TO THE CITY OF BRENTWOOD, FOR REAL PROPERTY IDENTIFIED AS APN 018-160-017, GENERALLY LOCATED AT GREGORY LANE.

WHEREAS, on January 26, 1993 by Resolution No. 93-1A, the Redevelopment Agency of the City of Brentwood authorized execution of an agreement between the Redevelopment Agency of the City of Brentwood and the Board of Supervisors of Contra Costa County to purchase tax-defaulted property, commonly known as Gregory Lane; and

WHEREAS, On June 17, 1993, a Tax Deed was recorded transferring Gregory Lane to the Redevelopment Agency of the City of Brentwood; and

WHEREAS, the City of Brentwood maintains all public roadways within the City limits therefore the Redevelopment Agency of the City of Brentwood wishes to convey the Gregory Lane roadway to the City of Brentwood; and

WHEREAS, Grant Deeds must be executed and recorded to transfer ownership of Gregory Lane right of way to the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood approves and authorizes the Executive Director or her designee to execute a Grant Deed for roadway purposes for Gregory Lane, and such other documents as may be needed to complete the transaction, hereby conveying real property on behalf of the Redevelopment Agency to the City of Brentwood, for real property identified as APN 018-160-017, generally located at Gregory Lane.
