Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute Amendment No. Two to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc., to increase the contract amount $110,000, plus a 10% contingency, for construction inspection and other related services.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute Amendment Two to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc., to increase the contract amount $110,000, plus a 10% contingency, for construction inspection and other related services.

PREVIOUS ACTION
On September 21, 2005, a Professional Services Agreement for Construction Inspection Services was executed with Parsons Brinckerhoff Construction Services, Inc. in the amount of $40,000.

On November 8, 2005, the Parties executed Amendment No. One to the Agreement to increase the maximum contract amount from $40,000 to $145,000.

BACKGROUND
With the continuing fast pace of infrastructure improvements and new subdivision/commercial development in the City, it is of utmost importance to have appropriate inspections performed to achieve a good quality product. The Construction Inspection Section within the Public Works Department, Engineering Division, had lost one inspection personnel in September 2005 and due to this lack of personnel to adequately handle construction inspection for general engineering projects and other related services, Parsons Brinckerhoff Construction Services, Inc. entered into a Professional Services Agreement with the City of Brentwood on September 21, 2005. The vacant Construction Inspection position has since been filled, but due to the large volume of residential and commercial construction activities throughout the City and also due to overtime requests from developers (overtime is paid by the developer), the Engineering Division would like to extend the construction inspection contract with Parsons Brinckerhoff Construction Services, Inc. on an as-needed basis.

Staff has been very satisfied with Parsons Brinckerhoff Construction Services, Inc.’s present and previous professional work performance; therefore, staff is making the recommendation that City Council approve Amendment No. Two to the Agreement with Parsons Brinckerhoff Construction Services, Inc. for construction inspection and other related services.

FISCAL IMPACT
The original contract of $40,000 was executed on September 21, 2005, by the City Manager as authorized by the City’s Purchasing Policy. Amendment No. One was approved on November 8, 2005, increasing the maximum contract amount to $145,000. The continuing additional services of Parsons Brinckerhoff Construction Services, Inc. require Amendment No. Two to be approved by the City Council. The funds for this amendment in the amount of $110,000, along with the previous contract amount of $145,000, brings the new total contract amount to $255,000, plus a 10% contingency of $11,000, for a total of $266,000, which has been budgeted in the 2005/06 – 2006/07 Final Operating Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. TWO TO THE PROFESSIONAL SERVICES AGREEMENT WITH PARSONS BRINCKERHOFF CONSTRUCTION SERVICES, INC., TO INCREASE THE CONTRACT AMOUNT $110,000, PLUS A 10% CONTINGENCY, FOR CONSTRUCTION INSPECTION AND OTHER RELATED SERVICES.

WHEREAS, due to lack of personnel in the Construction Inspection Section within the Public Works Department, Engineering Division to adequately handle construction inspection for general engineering projects and other related services, Parsons Brinckerhoff Construction Services, Inc. entered into a Professional Services Agreement with the City of Brentwood on September 21, 2005; and

WHEREAS, the original Professional Services Agreement was for the maximum amount of $40,000; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute Amendment No. Two to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc., to increase the contract amount $110,000, which brings the new total contract amount to $255,000, plus a 10% contingency of $11,000, for a total amount of $266,000, for construction inspection and other related services.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 27th day of June 2006 by the following vote:
