CITY COUNCIL AGENDA ITEM NO. 15

Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Grant of Easement with East Bay Municipal Utility District (EBMUD) for the extension of O’Hara Avenue, generally located on the north side of Grant Street and east of the railroad tracks between Grant Street and Lone Tree Way.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Grant of Easement and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with East Bay Municipal Utility District (EBMUD), for a portion of real property necessary for the O’Hara Avenue Extension – Phase 1 project identified as APN 016-200-004, generally located on the north side of Grant Street and east of the railroad tracks between Grant Street and Lone Tree Way.

PREVIOUS ACTION
On April 5, 2005, by Resolution No. 05-19, Planning Commission of the City of Brentwood approved Sterling Preserve lll, Vesting Tentative Subdivision Map No. 8875, and adopted the Mitigated Negative Declaration, which included Conditions of Approval Item No. 22, requiring the extension of O’Hara Avenue.

On May 23, 2006, by Resolution No. 2006-126, City Council certified and approved the Negative Declaration and adopted the City’s 2006/007 – 2010/11 Capital Improvement Program that included the O’Hara Avenue Extension – Phase 1 developer project.

BACKGROUND
The acceptance of the Grant of Easement from EBMUD for the extension of O’Hara Avenue is critical to complete the missing link from Grant Street to Lone Tree Way. When this project is complete it will improve access to commercial areas in downtown Brentwood from Lone Tree Way, a regional roadway arterial, and also will provide additional traffic circulation from downtown Oakley (Highway 4) to downtown Brentwood.

The easement document not only allows for the construction of the roadway and the necessary infrastructure (ie: public utilities) but includes an easement for a 30-inch potable waterline and a 12-inch non-potable waterline, which will both be extended up to Lone Tree Way.

The project will consist of constructing approximately 2,600 linear feet of a 96-foot wide collector street with 16-foot wide median and 20-foot parkway on each side of the street. The utility lines, 30-inch water line, 12-inch non-potable waterline, 12-inch sanitary sewer, 18-inch and 24-inch storm drain lines have been installed for approximately half the required distance as part of Subdivision No. 8546, and will be completed with this phase. This project will also include the construction of the box culvert bridge over the Flood Control right-of-way and the concrete slab over the EBMUD right-of-way.

FISCAL IMPACT
The project will be constructed by the developer as a condition of approval. However, being offsite, it will be paid for by Roadway Facility Fees. This project will increase pavement management. Annual operating and maintenance for roadway and utility work is estimated to be $34,086.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A GRANT OF EASEMENT AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, WITH EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD), FOR A PORTION OF REAL PROPERTY NECESSARY FOR THE O’HARA AVENUE EXTENSION – PHASE 1 PROJECT IDENTIFIED AS APN 016-200-004, GENERALLY LOCATED ON THE NORTH SIDE OF GRANT STREET AND EAST OF THE RAILROAD TRACKS BETWEEN GRANT STREET AND LONE TREE WAY.

WHEREAS, a portion of real property identified as APN 016-200-004, generally located on the north side of Grant Street and east of the railroad tracks between Grant Street and Lone Tree Way is required to complete the missing link to extend O’Hara Avenue from Grant Street to Lone Tree Way; and

WHEREAS, the Grant of Easement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a Grant of Easement and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with East Bay Municipal Utility District (EBMUD), for a portion of real property necessary for the O’Hara Avenue Extension – Phase 1 project, identified as APN 016-200-004, generally located on the north side of Grant Street and east of the railroad tracks between Grant Street and Lone Tree Way.
