Subject/Title: Adopt a Resolution authorizing the Mayor to sign Letters of Support to Congressman Pombo and Congresswoman Tauscher requesting their assistance on the necessary permit approvals for the construction of the State Route 4 Bypass – Segment 3 project.

RECOMMENDATION
Adopt a Resolution authorizing the Mayor to sign Letters of Support to Congressman Pombo and Congresswoman Tauscher requesting their assistance on the necessary permit approvals for the construction of the State Route 4 Bypass – Segment 3 project.

BACKGROUND
The State Route 4 Bypass Authority is currently out to bid for the construction of Segment 3 of the State Route 4 Bypass. Segment 3 is from Balfour Road south to Marsh Creek Road with the widening of Marsh Creek Road to a two lane expressway connection back to existing Highway 4 toward Discovery Bay/Stockton. There will also be additional lanes constructed from the Marsh Creek Road/State Route 4 Bypass intersection to Vasco Road (at Walnut Boulevard) for traffic traveling to/from Interstate 580 and the Livermore area. The total estimated construction cost of Segment 3 is $50 million.

The State Route 4 Bypass Authority is still awaiting the permit approvals from the U.S. Fish and Wildlife Service and the U.S. Army Corp of Engineers before any construction can begin on Segment 3. The construction bids are due on June 29, 2006, and the Bypass Authority is prepared to call a special meeting of the Board to award the construction contract, as soon as the environmental permits are received, so that construction can begin as soon as possible. Segment 3 is a vital link that will complete the State Route 4 Bypass as Segment 2 (from Lone Tree Way to Balfour Road) is already finished and Segment 1 (from Highway 4 in Antioch to Lone Tree Way) is currently under construction. The completion of Segment 3 will improve traffic flow and will also help with job creation and economic growth in this area.

The State Route 4 Bypass Authority, along with the County of Contra Costa and the Cities of Brentwood, Antioch, and Oakley, would like to send letters of support to Congressman Pombo and Congresswoman Tauscher requesting their assistance with the U.S. Fish and Wildlife Service and the U.S. Army Corp of Engineers to expedite the permit approvals for the State Route 4 Bypass - Segment 3. Their assistance is necessary, for timely issuance of necessary permits, so that the Bypass Authority can award the construction contract and have work commence ASAP.

FISCAL IMPACT
There is no fiscal impact to the City of Brentwood.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE MAYOR TO SIGN LETTERS OF SUPPORT TO CONGRESSMAN POMBO AND CONGRESSWOMAN TAUSCHER REQUESTING THEIR ASSISTANCE ON THE NECESSARY PERMIT APPROVALS FOR THE CONSTRUCTION OF THE STATE ROUTE 4 BYPASS – SEGMENT 3 PROJECT.

WHEREAS, the State Route 4 Bypass Authority is currently out to bid for the construction of Segment 3 of the State Route 4 Bypass; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the Mayor to sign Letters of Support to Congressman Pombo and Congresswoman Tauscher requesting their assistance on the necessary permit approvals for the construction of the State Route 4 Bypass – Segment 3 project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of June 2006 by the following vote:
