RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute the First Amendment to Agreement for Maintenance and Electrical Facility Cost Sharing of the State Route 4 Bypass in the City of Brentwood.

PREVIOUS ACTION
On May 11, 1999, City Council approved an Agreement with the Bypass Authority to construct the State Route 4 Bypass Segment 2, from Lone Tree Way to Balfour Road.

On April 9, 2002, City Council adopted Resolution No. 2513, to approve an agreement with the Bypass Authority for law enforcement services on the State Route 4 Bypass from Lone Tree Way to Balfour Road.

On September 23, 2003, City Council adopted Resolution No. 2990, to approve and authorize the City Manager to execute an Agreement for Maintenance and Electrical Facility Cost Sharing of the State Route 4 Bypass in the City of Brentwood.
BACKGROUND
The City of Brentwood and the Bypass Authority have been working together for several years to implement the construction of the State Route 4 Bypass, Segment 2, from Lone Tree Way to Balfour Road. This segment of the Bypass was open for traffic in 2002. Previously approved agreements authorize the City to provide law enforcement services, roadway maintenance and traffic signal operations and maintenance. The agreements outline types and levels of service to be provided by the City in addition to Authority’s reimbursement to the City for all costs incurred and 50% each cost sharing for maintenance of traffic signals at intersections of the Bypass with City roadways. With these agreements in place, the City is able to better ensure the safety of motorists within the City’s jurisdiction.

The proposed amendment will add landscape maintenance to the scope of City responsibility, with full reimbursement, including an amount for City administration, to be provided by the Bypass Authority. With the City providing landscape services, we will be able to maintain a level of service consistent with City roadways and enhancing the City limits.

FISCAL IMPACT
All annual maintenance costs, plus 20% to cover City administration, in an amount not to exceed $50,000, will be provided by the Bypass Authority. In addition, the Authority will be providing for initial clean up costs incurred upon City assumption of maintenance responsibility.

The approval of this amendment will necessitate a General Fund budget expenditure increase in the amount of $51,500, and offsetting revenue increases in the amount of $62,000. This will have a net affect of additional revenue to the General Fund in the amount of $10,500. These amendments will be included in the 2006/07 Operating Budget Amendments that are scheduled to go to the City Council on June 27, 2006.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT TO THE AGREEMENT FOR MAINTENANCE AND ELECTRICAL FACILITY COST SHARING OF THE STATE ROUTE 4 BYPASS IN THE CITY OF BRENTWOOD.

WHEREAS, on May 11, 1999, City Council approved an Agreement with the Bypass Authority to construct the State Route 4 Bypass Segment 2, from Lone Tree Way to Balfour Road; and

WHEREAS, on April 9, 2002, City Council adopted Resolution No. 2513, to approve an agreement with the Bypass Authority for law enforcement services on the State Route 4 Bypass from Lone Tree Way to Balfour Road; and

WHEREAS, on September 23, 2003, City Council adopted Resolution No. 2990, to approve and authorize the City Manager to execute an Agreement for Maintenance and Electrical Facility Cost Sharing of the State Route 4 Bypass in the City of Brentwood; and

WHEREAS, it is the City’s intent to keep roadways safe and clean and to provide a consistent level of service within the City’s jurisdiction.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that:
1. the First Amendment to the Agreement for Maintenance and Electrical Facility Cost Sharing of the State Route 4 Bypass in the City of Brentwood is hereby approved to include landscape maintenance services.

2. the City Manager is hereby authorized to execute same amendment.
