RECOMMENDATION
Adopt a Resolution to amend Resolution No. 98-39, to designate the Director of Public Works/City Engineer and/or his/her designee(s) as the City of Brentwood’s representative to the Contra Costa County Clean Water Program (Group Program) management and its sub-committees.

PREVIOUS ACTION
On March 2, 1998, City Council approved Resolution No. 98-39, approving the City of Brentwood’s participation in the Contra Costa Clean Water Program (Group Program), authorizing the City Manager to approve the modified Joint Municipal NPDES Program Agreement and designating the City Engineer and the Senior Engineer as the City of Brentwood representatives to the Group Program’s management and its sub-committees.

BACKGROUND
Participation in the Contra Costa Clean Water Program requires City Council action designating the City of Brentwood representatives to the Group Program’s management and its sub-committees. Previously, the City Engineer and Senior Engineer were designated as those representatives; however, staff recommends that in lieu of assigning a specific job title (i.e. Senior Engineer) as a representative, the wording be changed to designate the Director of Public Works/City Engineer and/or his/her designee(s) to eliminate the need for City Council action when the duty of serving as a representative is assigned to an individual other than the Senior Engineer.

FISCAL IMPACT
This amendment is for administrative purposes only and would not affect the approved NPDES budget in the 2005/06 – 2006/07 Final Operating Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AMEND RESOLUTION NO. 98-39, TO DESIGNATE THE DIRECTOR OF PUBLIC WORKS/CITY ENGINEER AND/OR HIS/HER DESIGNEE(S) AS THE CITY OF BRENTWOOD’S REPRESENTATIVE TO THE CONTRA COSTA COUNTY CLEAN WATER PROGRAM (GROUP PROGRAM) MANAGEMENT AND ITS SUB-COMMITTEES.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that:

1. Resolution No. 98-39, is amended to designate the Director of Public Works/City Engineer and/or his/her designee(s) as the City of Brentwood’s representative to the Contra Costa County Clean Water Program (Group Program) management and its sub-committees.

2. All other provisions of Resolution No. 98-39, shall remain in full force and effect.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 13th day of June 2006 by the following vote:
