Subject/Title: Adopt a Resolution accepting the work performed by Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128, and direct the City Clerk to file the Notice of Completion with the County Recorder.

PREVIOUS ACTION
On July 23, 2002, by Resolution No. 2620, City Council awarded the construction contract for the Sunset Industrial Complex, CIP Project No. 336-3128, to Teichert Construction.

On November 25, 2003, by Resolution No. 3027, City Council authorized the City Manager to execute change orders for installation of cul-de-sacs, a traffic signal and construction management services with The Covello Group and Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program, which included the Sunset Industrial Complex, CIP Project No. 336-3128.

On October 11, 2005, by Resolution No. 2005-250, City Council approved a contract amendment with Teichert Construction for additional joint trench infrastructure and IPARQ Way at Sunset Industrial Complex, CIP Project No. 336-3128.

BACKGROUND
Teichert Construction was awarded the construction contract for Sunset Industrial Complex on July 23, 2002. The layout design and joint trench infrastructure was originally designed to support nine (9) parcels. Requests for proposals were distributed to interested buyers in late spring 2003 and responses indicated a need for more industrial-zoned property. The layout was reconfigured to include two (2) cul-de-sacs and a total of 19 parcels, which better utilized the land use and accommodated the majority of requests received. A new road, IPARQ Way was created to accommodate access to the lot north of Elkins Way and a traffic signal was installed at the intersection of Sunset Road and Elkins Way.

The success of this project is indicated in the fact that 16 parcels have already been sold and 3 parcels are pending sale.

All the improvements are complete per the plans and specifications and the Contractor has met their contractual obligation. Staff is making the recommendation to accept the work performed by Teichert Construction.

FISCAL IMPACT
Total contract amount for this work with Teichert, including the 10% contingency and approved change orders, is $4,697,218.40. The work is complete and total project construction expenditures are $4,583,339.46.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY TEICHERT CONSTRUCTION FOR THE SUNSET INDUSTRIAL COMPLEX, CIP PROJECT NO. 336-3128, AND DIRECT THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on July 23, 2002, by Resolution No. 2620, City Council awarded the construction contract for the Sunset Industrial Complex, CIP Project No. 336-3128, to Teichert Construction; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128, and directs the City Clerk to file the Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on July 23, 2002 with Teichert Construction for work performed on Sunset Industrial Complex for CIP Project No. 336-3128.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work.

On the 13th day of June 2006, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
