Subject/Title: Approve a Resolution Amending the City’s 2005/06 Cost Allocation Plan and Schedule of City Fees to include Police Booking Fees of $170.

RECOMMENDATION
Staff recommends approval of a resolution amending the City’s 2005/06 Cost Allocation Plan and Schedule of City Fees to include Police Booking Fees of $170.

PREVIOUS ACTION
The City Council adopted Resolution 2005-222 on September 13, 2005 establishing the 2005/06 Cost Allocation Plan and Schedule of City Fees.

BACKGROUND
Currently, the City pays booking fees in the amount of $170 for every person arrested by the Police Department that is transported and booked into the Contra Costa County Detention Facility in Martinez.

The City plans on participation in a Booking Fee Reimbursement program. Many other cities in the County participate in this program with the Contra Costa County Superior Court, including Antioch Police Department and the Pittsburg Police Department. The program would be initiated by the Police Department, beginning with notifying the court system of the City’s intent to collect the costs of booking upon conviction of the defendant.

This is reimbursement allowed under Government Code section 29550.1 which specifies conditions under which the court orders a convicted individual to reimburse the city, special district, or other local arresting agency for cost of booking a defendant into the county jail and for fingerprinting. At the time of sentencing for the offense the individual convicted would be ordered by the court to reimburse the City of Brentwood for a criminal justice administration fee. This administration fee is the cost of county jail booking fees of $170 incurred by the City. It would further direct the convicted individual to pay the designated amount within 20 working days from the date of sentencing. If the subject were in custody, they would be directed to pay the amount designated within 20 days after release from jail.

FISCAL IMPACT
This City could potentially recover the current booking fees in the amount of $170 per booking for those persons who are convicted. It should be noted that the cost of booking fees is not static, and can be raised by the County of Contra Costa at any time through resolution. Not all individuals arrested are prosecuted by the District Attorney office, and therefore are never convicted. Yearly costs of booking fees to the City for 2005/06 are expected to be $80,184.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMMENDING THE 2005/06 COST ALLOCATION PLAN AND SCHEDULE OF CITY FEES TO INCLUDE POLICE BOOKING FEES OF $170.

WHEREAS, the City Council adopted Resolution 2005-222 on September 13, 2005 establishing the 2005/06 Cost Allocation Plan and Schedule of City Fees; and

WHEREAS, Brentwood pays booking fees in the amount of $170 for every person arrested by the Police Department that is transported and booked into the Contra Costa County Detention Facility in Martinez; and

WHEREAS, Government Code Section 29550.1 specifies conditions under which a court may order a convicted individual to reimburse the city; and

WHEREAS, yearly cost of booking fees to the City for 2005/06 are expected to be $80,184.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the 2005/06 Cost Allocation Plan and Schedule of City Fees is amended to include Police Booking Fees of $170.
