RECOMMENDATION
Adopt a Resolution approving and authorizing the submittal of a grant proposal to the California Integrated Waste Management Board for funding in an amount not to exceed $175,000 from the Targeted Rubberized Asphalt Concrete Incentive Grant Program and authorizing the City Manager or her designee to execute any and all documents necessary to secure the grant funds and implement the project on streets included in the 2006/2007 Pavement Management Program, CIP 336-3083.

BACKGROUND
The California Integrated Waste Management Board (CIWMB) receives an annual appropriation from the California Tire Recycling Management Fund (Tire Fund) to administer the Tire Recycling Act (Act). As part of the Act, CIWMB is offering the Targeted Rubberized Asphalt Concrete (RAC) Incentive Grant Program to encourage the use of waste tire rubber and thereby reduce the landfill disposal and stockpiling of California waste tires. We can help protect and preserve natural resources and safeguard against buildup of waste tire stockpiles for the future.

CIWMB will award the grants on a competitive basis for projects using a minimum of 3,500 tons of RAC. The RAC must be made up of crumb rubber from 100% California waste tires and having at least 15% rubber by weight of the total blend. The blend is a combination of paving grade asphalt cements, ground recycled tire and other additives used as a binder.

RAC is a proven product which has been used for road rehabilitation projects for over 25 years and in a project such as this offers a number of benefits:

 Resists cracking
 Reduces traffic noise

FISCAL IMPACT
There is no local match requirement in this program. By constructing the project, the City is providing a "match" for the project since the Targeted Rubberized Asphalt Concrete Incentive Grant program only reimburses the differential (additional) cost of using RAC in lieu of conventional asphalt concrete (AC). The maximum funding any jurisdiction may be awarded is $175,000. Since the project is currently in the design phase and the amount of RAC to be used is an estimate, the actual reimbursement will be in an amount not to exceed $175,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE SUBMITTAL OF A GRANT PROPOSAL TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD (CIWMB) FOR FUNDING IN AN AMOUNT NOT TO EXCEED $175,000 FROM THE TARGETED RUBBERIZED ASPHALT CONCRETE (RAC) INCENTIVE GRANT PROGRAM AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO SECURE THE GRANT FUNDS AND IMPLEMENT THE PROJECT ON STREETS INCLUDED IN THE 1006/2007 PAVEMENT MANAGEMENT PROGRAM, CIP 336-3083.

WHEREAS, the CIWMB receives an annual appropriation from the California Tire Recycling Management Fund to administer the Tire Recycling Act (Senate Bill 937, Vuich, Statutes of 1990, Chapter 35); and

WHEREAS, Public Resources Code Section (ORC) 42872.5 authorizes the California Integrated Waste Management Board (CIWMB) to establish a grant program to fund rubberized asphalt concrete (RAC) projects; and

WHEREAS, the CIWMB is offering the Targeted Rubberized Asphalt Concrete (RAC) Incentive Program to encourage the use of waste tire rubber and thereby reduce the landfill disposal and stockpiling of California waste tires; and

WHEREAS, the Targeted RAC Incentive Program grant funds are being provided to cover the differential cost of using RAC in lieu of conventional asphalt concrete and to offset costs for deflection testing and/or quality assurance/quality control (QA/QC) testing; and

WHEREAS, the CIWMB has been delegated the responsibility for the administration of the program, setting up necessary procedures governing application by local governments and their subdivisions under the program; and

WHEREAS, said procedures established by the CIWMB require the applicant to certify, by resolution, approval of the application before submission of said application to the State; and

WHEREAS, if awarded a grant, the applicant will enter into an agreement with the State of California for development of the project.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood

1. Approve and authorizes the submittal of an application for grant funds to the California Integrated Waste Management Board Targeted Rubberized Asphalt Concrete Incentive Grant Program.
2. The City Manager or her designee is hereby authorized and empowered to execute in the name of the City of Brentwood all necessary applications, contracts, agreements, amendments, and payment requests hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
