Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Purchase Agreement with Towncentre Commons for the O’Hara Loop Realignment, CIP Project No. 336-3145.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Purchase Agreement, and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with Towncentre Commons, L.P., a California limited partnership, for a portion of real property necessary for the O’Hara Loop Realignment, CIP Project No. 336-3145, identified as APN 013-010-079, generally located at the northeast corner of Central Boulevard and Second Street.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council adopted the 2004/05 – 2008/09 Capital Improvement Program (CIP) that included the O’Hara Loop Realignment, CIP Project No. 336-3145.

On August 10, 2004, by Resolution No. 2004-196, City Council approved the amendment of the O’Hara Loop Realignment, CIP Project No. 336-3145.

On May 9, 2006, by Resolution No. 2006-95, City Council amended the 2005/06 – 2009/10 Capital Improvement Program (CIP) to reinstate the O’Hara Loop Realignment, CIP Project No. 336-3145 and amended the project budget in the amount of $50,000, in order to finalize the purchase of the right-of-way currently being used for public improvements in connection with the extension of Second Street.

BACKGROUND
This project extended 700 linear feet of Second Street to an arterial street (90 feet right-of-way) consisting of two travel lanes in each direction, bike lanes, sidewalks, median, two traffic signals and landscaping on each side of the Second Street extension and a soundwall from Central Boulevard to O’Hara Avenue and Second Street intersection. This project did improve traffic flow, circulation, and safety to bicyclists and pedestrians in the downtown area.

The City acquired the property necessary to realign O’Hara Avenue and extend Second Street back in 1996. At the time, right-of-way was not required to construct a sidewalk and soundwall on the east side of the roadway, as well as easements for the new signal equipment at the apartment complex entrance, and a utility easement for a power source for the traffic signal and irrigation controller. Since the design for the project had not yet begun, these items were unknown at the time. When the design was completed and the additional right-of-way and easements were determined, the City entered into a Permit to Enter and Construct with Towncenter Commons during the construction phase. Now that the project is complete, open to the public and Council has accepted the improvements, it is time to move forward with finalizing the purchase of the right-of-way currently being used for public improvements.

FISCAL IMPACT
The acquisition cost of $36,546, has been budgeted through the amended budget for the O’Hara Loop Realignment, CIP Project No. 336-3145, which is funded by Roadway Facility Fees approved on May 9, 2006 by City Council. The annual Operating/Maintenance Cost has been estimated at $4,236 a year.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A PURCHASE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, WITH TOWNCENTRE COMMONS, L.P., A CALIFORNIA LIMITED PARTNERSHIP, FOR A PORTION OF REAL PROPERTY NECESSARY FOR THE O’HARA LOOP REALIGNMENT, CIP PROJECT NO. 336-3145, IDENTIFIED AS APN 013-010-079, GENERALLY LOCATED AT THE NORTHEAST CORNER OF CENTRAL BOULEVARD AND SECOND STREET.

WHEREAS, real property generally located at the northeast corner of Central Boulevard and Second Street in the City of Brentwood, identified as APN 013-010-079, is necessary for the O’Hara Loop Realignment, CIP Project No. 336-3145; and

WHEREAS, a purchase agreement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a Purchase Agreement, and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with Towncentre Commons, L.P., a California limited partnership, for a portion of real property necessary for the O’Hara Loop Realignment, CIP Project No. 336-3145, identified as APN 013-010-079, generally located at the northeast corner of Central Boulevard and Second Street.
