Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute the construction contract with Talus Construction, Inc. and necessary documents for the Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635, in the amount of $238,728 plus a 10% contingency for a total amount of $262,600.80.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute the construction contract with Talus Construction, Inc. and necessary documents for the Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635, in the amount of $238,728 plus a 10% contingency for a total amount of $262,600.80.

PREVIOUS ACTION
On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635.

On June 28, 2005, by Resolution No. 2005-157, City Council approved the contract documents and awarded the construction contract for Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635 to Jimmy’s Landscaping & General Engineering.

BACKGROUND
On January 12, 2005, a contract with BKF Engineering was entered into for the design of the Sarah Street Water Distribution System Improvements. The contract amount was $30,910; therefore, in compliance with the City’s Purchasing Policy 10-7, it did not go to City Council as it was under $50,000.

The current work to be done consists of the replacement of an 8-inch domestic water line and an 8-inch sanitary sewer line along Sarah Street between Dainty Avenue and Summer Circle.

The Water Division has repaired nine water leaks in this section of water line over the last three years. The CIP project was created to be proactive in our main line replacement efforts and to reduce water loss within the City. The scope of the original project was to replace only the 8-inch water line. In an effort to minimize the residential inconvenience and traffic impacts caused by the nature of this project; the Wastewater Division was contacted to conduct an inspection of the collection system on Sarah Street. Staff found numerous low spots and degradation of the existing 8-inch sewer main by televising the line. Staff was unable to televise the entire sewer main due to tight bends and a reduction in pipe size. Staff concluded it was more economical to replace both the 8-inch water line and the 8-inch sewer line simultaneously.

The City of Brentwood originally advertised the project for public bid beginning May 27, 2005 with the bid opening on June 16, 2005. A total of two bids were received. The bids were reviewed and the lowest responsive, responsible bid was received from Jimmy’s Landscaping & General Engineering, in the amount of $179,000. The other bid received was from Pacific Underground Construction in the amount of $263,475.

Due to Jimmy’s Landscaping & General Engineering’s failure to provide the required bond and insurance documents within the time period required by the bid documents, staff re-bid the project.

Staff, again, advertised the project for construction on March 6, 2006 and bids were opened on April 21, 2006. A total of three (3) bids were received. The bids were reviewed and the lowest responsive, responsible bid was received from Talus Construction, Inc.

The three (3) bids were as follows:

1. Talus Construction, Inc. $238,728
2. Jimmy’s Landscaping & General Engineering $239,488
3. Pacific Underground Construction, Inc. $261,625

FISCAL IMPACT
The total contract amount of $238,728 plus a 10% contingency of $23,872.80, for a total amount of $262,600.80 will be expended through the Capital Improvement Program, Project No. 562-5635.

ADOPT A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION CONTRACT WITH TALUS CONSTRUCTION, INC. AND NECESSARY DOCUMENTS FOR THE SARAH STREET WATER DISTRIBUTION SYSTEM IMPROVEMENTS, CIP PROJECT NO. 562-5635, IN THE AMOUNT OF $238,728 PLUS A 10% CONTINGENCY FOR A TOTAL AMOUNT OF $262,600.80.

WHEREAS, staff has repaired nine water leaks on the Sarah Street line in the last three years; and

WHEREAS, the existing collection system is in such a state of disrepair, staff is unable to completely televise the entire line; and

WHEREAS, staff determined that the 8-inch water line and the 8-inch sewer main need replacement on Sarah Street between Dainty Avenue and Summer Circle; and

WHEREAS, staff concluded it was more economical to replace both the 8-inch water line and the 8-inch sewer line simultaneously; and

WHEREAS, on January 12, 2005, a contract with BKF Engineering was entered into for the design of the Sarah Street Water Distribution System Improvements CIP project in the amount of $30,910; and

WHEREAS, the City of Brentwood initially advertised the project for public bid beginning May 27, 2005 and bids were opened on June 16, 2005, and

WHEREAS, a total of two bids were received with Jimmy’s Landscaping & General Engineering submitting the lowest bid in the amount of $179,000; and

WHEREAS, on June 28, 2005, by Resolution No. 2005-157, City Council approved the contract documents and awarded the construction contract for Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635 to Jimmy’s Landscaping & General Engineering; and

WHEREAS, due to Jimmy’s Landscaping & General Engineering’s failure to provide the required bond and insurance documents within the time period required by the bid documents, staff re-bid the project; and

WHEREAS, staff, again, advertised the project for construction on March 6, 2006 and bids were opened on April 21, 2006; and

WHEREAS, a total of three (3) bids were received and the lowest responsive, responsible bid was from Talus Construction, Inc. in the amount of $238,728.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City shall approve and authorize the City Manager to execute the construction contract with Talus Construction, Inc. and necessary documents for the Sarah Street Water Distribution System Improvements, CIP Project No. 562-5635, in the amount of $238,728 plus a 10% contingency for a total amount of $262,600.80.
