Adopt a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Sterling Preserve I, Meritage Homes
Subdivision No. 8453, located north of Grant Street and east of Fairview
On June 5, 2001, by Resolution No. 01-47, Planning Commission approved
Tentative Subdivision Map No. 8453, with conditions.
On May 14, 2002, by Resolution No. 2541, City Council approved Final
Subdivision Map No. 8453, accepting improvement securities and approving a
Subdivision Improvement Agreement.
This subdivision, located north of Grant Street and east of Fairview Avenue,
has been developed by Meritage Homes and contains 53 single-family
residential lots. All public improvements required by the project’s
Conditions of Approval have been constructed and inspected for conformance
with the approved improvement plans including sewer, water and storm drain
lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping.
As a part of this project, Meritage Homes constructed the east side Fairview
Avenue widening, north of Grant Street, as well as a regional trail and
landscaping along the EDMUD aqueduct south of the project. Meritage Homes
has provided Maintenance Bonds to cover the twelve-month warranty period for
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
3,750 LF of 8” sewer lines, 1,806 LF of 12” sewer lines, 2,395 LF of 8”
waterline, 1,554 LF of 12” waterline, 3,464 LF of various diameter storm
drain, 6,810 LF of 5’ wide sidewalk, 3,820 LF of pavement, 6,810 LF of curb
and gutter, 23 streetlights, 3,850 LF of fiber optic conduit, 120,545 SF of
landscaping and irrigation and 4,340 LF of asphalt trail.
When the Final Map was approved by the City Council, the right-of-way offers
of dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs in the
amount of approximately $59,875, associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 99-03 has been formed for this
subdivision and will be responsible for the street lighting and landscape

RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S
RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP;
ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION
MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR
STERLING PRESERVE I, MERITAGE HOMES SUBDIVISION NO. 8453, LOCATED NORTH OF
GRANT STREET AND EAST OF FAIRVIEW AVENUE.
WHEREAS, on June 5, 2001, by Resolution No. 01-47, Planning Commission
approved Tentative Subdivision Map No. 8454, with conditions; and
WHEREAS, on May 14, 2002, by Resolution No. 2541, City Council approved
Final Subdivision Map No. 8453, accepting improvement securities and
approving a Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
1. The public improvements are accepted for maintenance and all offers of
dedication for rights-of-way, easements and parcels of land intended for
public use as shown on the Final Map are hereby accepted;
2. The Maintenance Bond to guarantee against defects in material and
workmanship for a period of twelve months is hereby accepted;
3. The Subdivision Performance and Payment Bonds will be released within
sixty (60) days of the passage of this Resolution;
4. The City Clerk is hereby directed to file this Resolution with the
Recorder of Contra Costa County.
