RECOMMENDATION
Approve temporary use of Agency-owned property for CornFest 2006 parking from July 7 through July 9, 2006.

PREVIOUS ACTION
For the last several years, the Redevelopment Agency has permitted the Liberty High School sports organizations to use the parcel located on the southeast corner of Oak Street and Walnut Boulevard for a parking lot for the CornFest. For these sports organizations, this event is the single largest fundraiser of the year to support their activities.

BACKGROUND
The Chamber of Commerce CornFest Board and Delta Wrestling Club have again requested the use of Agency-owned property for parking purposes. Historically, the property located at the corner of Oak and Walnut Streets has been designated and used for parking. However, during the preparation for Walnut Boulevard widening, burrowing owls were found on this site and mitigation measures must be taken to protect the owls during their nesting season from June to August. Consequently, the parcel located at the corner of Oak and Walnut Streets cannot be used this year for parking. The parcel at 1000 Central Boulevard, at the northeast corner of Central and Walnut Boulevards, will be used as the alternative site for parking this year, in conjunction with the routine safety measures and efforts of the Brentwood police.

The Redevelopment Agency will be added as additional insured in the insurance coverage purchased by the Cornfest Board for the event, and the Board will indemnify the Redevelopment Agency against all claims, liability and loss resulting directly or indirectly from operations and activities on the property. The Board has further agreed to leave the property in a clean and orderly condition upon completion of the festival.
