Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Professional Services Agreement with ECO:LOGIC Consulting Engineers in an amount of $74,150, plus a 10% contingency for a total of $81,565, for project and construction management and inspection services for the Chloramination of Wells, CIP Project No. 562-5617 and Well #15, CIP Project No. 562-5631.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Professional Services Agreement with ECO:LOGIC Consulting Engineers in an amount of $74,150, plus a 10% contingency for a total of $81,565, for project and construction management and inspection services for the Chloramination of Wells, CIP Project No. 562-5617 and Well #15, CIP Project No. 562-5631.

PREVIOUS ACTION
On October 14, 2003, by Resolution No. 3002, City Council authorized the City Manager to execute a Professional Services Agreement with Luhdorff and Scalmanini Consulting Engineers, Inc., for pre-design services for Well # 15, CIP Project No. 562-5631, amended the project budget and authorized the City Manger to approve change orders up to 10% of the contract amount.

On January 11, 2005, by Resolution No. 2005-6, City Council authorized the City Manager to execute a Professional Services Agreement with Raines, Melton & Carella, Inc., to provide design services for Chloramination of Wells, CIP Project No. 562-5617 and amended the CIP Budget Sheet.

On April 26, 2005, by Resolution No. 2005-94, City Council authorized the termination of the agreement with Raines, Melton & Carella, Inc., for design services and executed a Professional Services Agreement with Camp Dresser and McKee, Inc., to provide design services for the Chloramination of Wells, CIP Project No. 562-5617.

On May 24, 2005, by Resolution No. 2005-115, City Council approved the 2005/06 – 2009/10 Capital Improvement Program, which included the Chloramination of Wells, CIP Project No. 562-5617 and Well #15, CIP Project No. 562-5631.

On August 23, 2005, by Resolution No. 2005-202, City Council authorized the City Manager to execute a Professional Services Agreement with Kimley-Horn and Associates, Inc., to provide design services for Well #15, CIP Project No. 562-5631.

On February 14, 2006, by Resolution No. 2006-29, City Council approved the Contract Documents and authorized the City Manager to execute a construction contract with Manito Construction, Inc., for the Chloramination of Wells, CIP Project No. 562-5617 and amended the CIP Budget Sheet to reflect increased industry construction and labor costs.

BACKGROUND
Well #15 is located across from the City of Brentwood’s Corporation Yard on Elkins Way. The well 15 site improvement project includes a new control system, chemical systems, permanent power and permanent fencing. A professional services agreement is in place with Kimley-Horn and Associates for the design services and preparation of the contract documents. Once these documents are ready, staff will be going out to bid on the construction phase of the project. Approving this contract with ECO:LOGIC completes the contracts necessary to see this project to completion.

The Chloramination of Wells project is converting the potable water disinfectant from chlorine to chloramines. Camp Dresser & McKee has provided design services and a construction contract is in place with Manito Construction, Inc. for the conversion.

ECO:LOGIC Consulting Engineers is prepared and qualified to manage and provide inspection services for both of these projects. Because of the commonality of these projects and ECO:LOGIC’s expertise, it is prudent to combine these projects under one agreement.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2005/06-2009/10 Capital Improvement Program and are available in the current budgets for these two projects. The cost for these services will be shared as follows:

Chloramination of Wells, CIP Project No. 562-5617 $ 7,000.00
Well #15, CIP Project No. 562-5631 $ 74,565.00

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH ECO:LOGIC CONSULTING ENGINEERS IN AN AMOUNT OF $81,565, INCLUDING A 10% CONTINGENCY FOR CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES FOR THE CHLORAMINATION OF WELLS, CIP PROJECT NO. 562-5617 AND WELL #15, CIP PROJECT NO. 562-5631.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Professional Services Agreement with ECO:LOGIC Consulting Engineers in an amount of $74,150, plus a 10% contingency for a total of $81,565, for project and construction management and inspection services for the Chloramination of Wells, CIP Project No. 562-5617 and Well #15, CIP Project No. 562-5631.
