Subject/Title: Adopt a Resolution accepting Improvements for Western Pacific Housing Subdivision No. 8697 (Phase II of TSM No. 8395), located south of Sand Creek Road and east of Fairview Avenue.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Western Pacific Housing, Subdivision No. 8697, located south of Sand Creek Road and east of Fairview Avenue.

PREVIOUS ACTION
On June 6, 2000, by Resolution No. 00-28, Planning Commission approved Tentative Subdivision Map No. 8395, with conditions.

On February 24, 2004, City Council was notified through an informational report of the approval of Final Subdivision Map No. 8697, acceptance of improvement securities and approval of a Subdivision Improvement Agreement.

On March 9, 2004, by Resolution No. 2004-45, City Council approved a Reimbursement Agreement with Western Pacific Housing for Master Plan Facility Improvements.

BACKGROUND
This subdivision, located south of Sand Creek Road and east of Fairview Avenue, has been developed by Western Pacific Housing and contains 8 single-family residential lots. It is the remainder parcel and second phase of Tentative Subdivision Map No. 8395 and is separated from the Phase I by Sand Creek Road. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. As a part of this project’s Conditions of Approval and in conjunction with Phase I of the project, Western Pacific Housing constructed the east side widening of Fairview Avenue south of Sunflower Lane, including the portion between Sand Creek Road and San Jose Avenue fronting existing residences. The Developer also extended the existing trail from Miwok Park south to Sand Creek Road and constructed a pedestrian bridge over Sand Creek. Western Pacific Housing provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities to serve this second phase: 236 LF of 8” sewer lines, 259 LF of 8” waterline, 352 LF of various diameter storm drain, 6,800 LF of 5’ wide sidewalk, 257 LF of pavement, 6,684 LF of curb and gutter, 2 streetlights, 350 LF of fiber optic conduit, and 18,000 SF of landscaping and irrigation.

When the Final Map was approved by the City Manager, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $6,700, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 99-03 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR WESTERN PACIFIC HOUSING SUBDIVISION NO. 8697, LOCATED SOUTH OF SAND CREEK ROAD AND EAST OF FAIRVIEW AVENUE.

WHEREAS, on June 6, 2000, by Resolution No. 00-28, Planning Commission approved Tentative Subdivision Map No. 8395, with conditions; and

WHEREAS, on February 24, 2004, City Council was notified through an informational report of the approval of Final Subdivision Map No. 8697, acceptance of improvement securities and approval of a Subdivision Improvement Agreement; and

WHEREAS, on March 9, 2004 by Resolution No. 2004-45, City Council approved a Reimbursement Agreement with Western Pacific Housing for Master Plan Facility Improvements; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that:

1. The public improvements are accepted for maintenance and all offers of dedication for rights-of-way, easements and parcels of land intended for public use as shown on the Final Map are hereby accepted;
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted;
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution;
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
