Subject/Title: Adopt a Resolution accepting Improvements for Wildflower, Western Pacific Housing Subdivision No. 8413, located north of Oak Street and west of Garin Parkway.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Wildflower, Western Pacific Housing, Subdivision No. 8413, located north of Oak Street and west of Garin Parkway.

PREVIOUS ACTION
On May 24, 2001, by Resolution No. 01-37, Planning Commission approved Tentative Subdivision Map No. 8413, with conditions.

On May 13, 2003, by Resolution No. 2850, City Council approved Final Subdivision Map No. 8413, accepting improvement securities and approving a Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located west of Garin Parkway and south of Sycamore Avenue, has been developed by Western Pacific Housing and contains 113 single-family residential lots. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. As a part of this project, Western Pacific Housing allocated a 3.26 acre parcel adjacent to Oak Street for senior housing and a 2.74 acre parcel adjacent to the Liberty Union High School for the future addition of athletic fields. The Developer also constructed the expansion of the High School student parking lot, through an agreement with the City to help alleviate downtown parking and the School District in exchange for credit against school impact fees. Western Pacific Housing provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 2,853 LF of 8” sewer lines, 1,202 LF of 12” sewer lines, 4,101 LF of 8” waterline, 4,261 LF of 12” waterline, 6,590 LF of various diameter storm drain, 12,177 LF of 5’ wide sidewalk, 6,087 LF of pavement, 12,212 LF of curb and gutter, 50 streetlights, 6,106 LF of fiber optic conduit, and 2,000 SF of landscaping and irrigation.

When the Final Map was approved by the City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $42,000, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-02 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR WILDFLOWER, WESTERN PACIFIC HOUSING SUBDIVISION NO. 8413, LOCATED NORTH OF OAK STREET AND WEST OF GARIN PARKWAY.

WHEREAS, on May 24, 2001, by Resolution No. 01-37, Planning Commission approved Tentative Subdivision Map No. 8413, with conditions; and

WHEREAS, on May 13, 2003, by Resolution No. 2850, City Council approved Final Subdivision Map No. 8413, accepting improvement securities and approving a Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that:

1. The public improvements are accepted for maintenance and all offers of dedication for rights-of-way, easements and parcels of land intended for public use as shown on the Final Map are hereby accepted;
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted;
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution;
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 25th day of April 2006 by the following vote:
