REDEVELOPMENT AGENCY AGENDA ITEM NO. 17

Subject/Title: Adopt a Resolution approving and authorizing the Executive Director or her designee to execute Grant Deeds and such other documents as may be needed to convey Redevelopment Agency-owned property to the City of Brentwood at the corner of Brentwood Boulevard and Guthrie Lane.

RECOMMENDATION
Adopt a Resolution approving and authorizing the Executive Director or her designee to execute a Grant Deed for roadway purposes for Guthrie Lane, a Grant Deed for the Police Station site at 9100 Brentwood Boulevard, and such other documents as may be needed to complete the transaction, hereby conveying real property on behalf of the Redevelopment Agency to the City of Brentwood, for portions of real property identified as APN 010-160-015, generally located at the southeast corner of Brentwood Boulevard and Guthrie Lane.

PREVIOUS ACTION
On September 17, 2003, by Resolution No. 2980, the City Council approved authorization for the City Manager to execute a purchase agreement for 9100 Brentwood Boulevard, APN 010-160-015 for the new Police Facility.

On November 8, 2005, by Resolution No. 2005-261, the City Council approved authorization for the City Manager to execute a Grant Deed transferring ownership of the property located at 9100 Brentwood Boulevard (APN 010-160-015) to the Brentwood Redevelopment Agency.

On November 8, 2005, by Resolution No. 102, the Redevelopment Agency authorized the Executive Director to accept a Grant Deed transferring ownership of the property located at 9100 Brentwood Boulevard (APN 010-160-015) from the City to the Brentwood Redevelopment Agency.

BACKGROUND
Transfer of 9100 Brentwood Boulevard from City ownership to Agency ownership allowed the execution of a lease agreement for the 20,000 square foot building and its parking area (400 Guthrie Lane) located on the eastern portion of 9100 Brentwood Boulevard to Precision Cabinets, L.C., for the expansion of their business. The Redevelopment Agency approved an Industrial Lease and Option to Purchase Agreement with Precision Cabinets, L.C. for 400 Guthrie Lane on December 13, 2005.

Staff commenced work with Northstar Engineering to separate 9100 Brentwood Boulevard into two parcels. This allows the western portion of the property, where the Police Facility is located, to be re-conveyed back to the City from the Agency and the eastern portion, 400 Guthrie Lane to be leased to Precision Cabinets.

During this process, Northstar Engineering noticed that the preliminary title report did not show a road right of way dedication for Guthrie Lane. In order to rectify this, the Guthrie Lane street right of way also needs to be conveyed to the City from the Agency.

FISCAL IMPACT
At this time, no funds shall be paid by the City to the Agency for 9100 Brentwood Boulevard or for the Guthrie Lane roadway. The future lease and/or sale proceeds of the Precision Cabinets parcel will be shared between the City and Agency in proportions that will reimburse the Agency for its direct and indirect expenses, including staff time and administrative overhead based on the current Cost Allocation Plan.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE EXECUTIVE DIRECTOR OR HER DESIGNEE TO EXECUTE A GRANT DEED FOR ROADWAY PURPOSES FOR GUTHRIE LANE, A GRANT DEED FOR THE POLICE STATION SITE AT 9100 BRENTWOOD BOULEVARD, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY CONVEYING REAL PROPERTY ON BEHALF OF THE REDEVELOPMENT AGENCY TO THE CITY OF BRENTWOOD, FOR PORTIONS OF REAL PROPERTY IDENTIFIED AS APN 010-160-015, GENERALLY LOCATED AT THE SOUTHEAST CORNER OF BRENTWOOD BOULEVARD AND GUTHRIE LANE.


WHEREAS, On September 17, 2003, by Resolution No. 2980, the City Council of the City of Brentwood approved authorization for the City Manager to execute a purchase agreement for 9100 Brentwood Boulevard, APN #010-160-015; and

WHEREAS, 9100 Brentwood Boulevard is located within the Merged Redevelopment Project Areas; and

WHEREAS, Community Redevelopment Law, Health & Safety Code Section 33220 authorizes cities to dedicate, sell or convey any of its property to a redevelopment agency for the purpose of cooperating in the planning, undertaking, or operation of redevelopment projects located within a redevelopment project area; and

WHEREAS, on November 8, 2005, by Resolution No. 2005-261, the City Council approved authorization for the City Manager to execute a Grant Deed transferring ownership of the property located at 9100 Brentwood Boulevard (APN 010-160-015) to the Brentwood Redevelopment Agency; and

WHEREAS, On November 8, 2005, by Resolution No. 102, the Redevelopment Agency authorized the Executive Director to accept a Grant Deed transferring ownership of the property located at 9100 Brentwood Boulevard (APN 010-160-015) from the City to the Brentwood Redevelopment Agency; and

WHEREAS, Grant Deeds must be executed and recorded to transfer ownership of the Police Station portion of 9100 Brentwood Boulevard and Guthrie Lane right of way to the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood approves and authorizes the Executive Director or her designee to execute a Grant Deed for roadway purposes for Guthrie Lane, a Grant Deed for the Police Station site at 9100 Brentwood Boulevard, and such other documents as may be needed to complete the transaction, hereby conveying real property on behalf of the Redevelopment Agency to the City of Brentwood, for portions of real property identified as APN 010-160-015, generally located at the southeast corner of Brentwood Boulevard and Guthrie Lane.
