CITY COUNCIL AGENDA ITEM NO. 10

Meeting Date: April 11, 2006

Subject/Title: Adopt a Resolution accepting the work performed by Electronic Technologies Corporation at the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709, and direct the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Electronic Technologies Corporation for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On November 9, 2004, by Resolution No. 2004-253, City Council approved the contract documents and awarded the construction contracts for the New Police Station (Group C), CIP Project No. 337-3142, with exception of Bid Packages #15 and #16 (which were re-bid), totaling $3,654,974.85.

BACKGROUND
The New Police Facility project is a multi prime project which required several trades to work within the specified site, all by separate contracts managed by staff as discussed with the task force during the project budgeting process. The attached Notice of Completion (NOC) reflects work completed by one of the trades per contractual obligations for this project. Electronic Technologies Corporation completed the security system work for the New Police Station. As a multi prime project, the work is completed in phases and staff recommends accepting the work performed by this trade as indicated in the attached NOC.

City Council has already accepted the work performed by Dean’s Acoustical Ceiling, Denham Contracting, Systems & Space, Pueblo Tile, BT Mancini, Concord Iron Works, Martinez Sheet Metal, Melloni Construction (Package #18 Casework), Pro-Fit Fire Services, Freas Plastering, Marina Mechanical, Metal Building Company, D&D Commercial Painting, Inc., Del Monte Electric Company, Inc., Legg, Inc., Melloni Construction (Package #9 Carpentry), Coast Building and McKay Construction.

There are two contracts that remain open at this time; Bay Cities Paving & Grading for the sitework and Melloni Construction for the glazing work (glass canopy). Staff is diligently working together with the contractors to complete these contracts.

FISCAL IMPACT
Total contract amount for the work performed by Electronic Technologies Corporation for the New Police Facility and City Data Center combined are as follows:

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY ELECTRONIC TECHNOLOGIES CORPORATION FOR THE NEW POLICE FACILITY, CIP PROJECT NO. 337-3142 AND CITY DATA CENTER, CIP PROJECT NO. 337-3709, AND DIRECT THE CITY CLERK TO FILE THE NOTICES OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, the New Police Facility project was a multi prime project which required several trades to work within the specified site, all by separate contracts; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the worked performed by Electronic Technologies Corporation for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709, as indicated on the Notice of Completion document, is hereby accepted, and the City Clerk is hereby directed to file the Notice of Completion with the County Recorder for this project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 11th day of April 2006 by the following vote:

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 9th day of November 2004, enter into an agreement with Electronic Technologies Corporation for the security system work at the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work for the New Police Facility, located at 9100 Brentwood Boulevard, Brentwood California 94513.

On the 11th day of April 2006, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
