Subject/Title: Adopt a Resolution approving a change order to the existing purchase order for City’s continued participation in the Contra Costa County Clean Water Program through Fiscal Year 2006/07 in an amount of $195,000, in accordance with the requirements of the Clean Water Act.

RECOMMENDATION
Adopt a Resolution approving a change order to the existing purchase order for City’s continued participation in the Contra Costa County Clean Water Program through Fiscal Year 2006/07 in an amount of $195,000, in accordance with the requirements of the Clean Water Act.

PREVIOUS ACTION
On March 2, 1998, City Council approved Resolution No. 98-39, authorizing participation in the Contra Costa Clean Water Program and approving the Joint Municipal NPDES Program Agreement.

On July 11, 2000, City Council approved Resolution No. 2110, approving the first amendment to the Contra Costa Clean Water Program Agreement to include the City of Oakley.

On July 22, 2003, City Council approved Resolution No. 2924, for Contra Costa Clean Water Program Agreement (2004 – 2010) and the purchase order was amended by $80,678.00 for City’s participation through Fiscal Year 2003/04.

BACKGROUND
The Federal Water Pollution and Control Act, commonly known as the Clean Water Act, was enacted in 1972 and amended in 1987. The Clean Water Act requires municipalities to obtain permits through the Regional Water Quality Control Board which outline programs and activities to control and minimize surface stormwater pollution. In order to comply with these regulations, Brentwood along with Contra Costa County, Contra Costa County Flood Control & Water Conservation District, and eighteen other incorporated cities have joined together to form the Contra Costa Clean Water Program (CCCWP). The CCCWP utilizes shared resources and activities to eliminate stormwater pollution through public education, inspection, enforcement activities, and industrial outreach. Significant economies of scale are realized by all participating agencies through utilization of shared resources and by reducing the need to hire additional staff to ensure compliance. Through continued participation in this program, the City is able to effectively and efficiently comply with the Clean Water Act.

FISCAL IMPACT
The costs incurred for group activities are distributed proportionately among all participants based on population. The City of Brentwood’s anticipated cost for Fiscal Years 2005/06 and 2006/07 is approximately $95,000 and $100,000, respectively. The recommended $195,000 increase allows the City to pay for its proportionate share of the CCCWP through Fiscal Year 2006/07. Actual costs are not fully realized until after the end of each fiscal year. NPDES funds were budgeted for these costs in the 2005/06 – 2006/07 Operating Budget. The purchase order must be increased periodically for the City’s continued participation in the CCCWP.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A CHANGE ORDER TO THE EXISTING PURCHASE ORDER FOR CITY’S CONTINUED PARTICIPATION IN THE CONTRA COSTA COUNTY CLEAN WATER PROGRAM THROUGH FISCAL YEAR 2006/07 IN AN AMOUNT OF $195,000, IN ACCORDANCE WITH THE REQUIREMENTS OF THE CLEAN WATER ACT.

WHEREAS, under the Federal Water Pollution Control Act, as amended in 1987, stormwater discharges from municipal separate storm sewer systems require coverage under the National Pollutant Discharge Elimination System (NPDES) Permit Program; and

WHEREAS, in California, the NPDES Permits are issued through the California State Water Resources Control Board and the nine (9) Regional Water Quality Control Boards; and

WHEREAS, the San Francisco Bay and Central Valley Regional Water Quality Control Boards mandated Contra Costa County, nineteen (19) of its incorporated Cities and the Contra Costa County Flood Control & Water Conservation District (Flood Control District) be covered under a Joint Municipal NPDES Permit; and

WHEREAS, these jurisdictions participated in permit application activities and received an original and reissued Joint Municipal NPDES Permit from the San Francisco Bay and/or Central Valley Regional Water Quality Control Boards; and

WHEREAS, cooperative efforts between the Cities, County and the Flood Control District in the Joint Municipal NPDES Permits have minimized the costs of the Program to all parties; and

WHEREAS, Contra Costa County, all nineteen (19) of its incorporated Cities and the Flood Control District are subject to a Program Agreement, which delineates Program activities, structure, membership, costs and participation.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approve a change order to the existing purchase order for City’s continued participation in the Contra Costa County Clean Water Program through Fiscal Year 2006/07 in an amount of $195,000, in accordance with the requirements of the Clean Water Act.
