Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with Jeffry Family Partnership, Design Review (DR) No. 04-12, an office building, located at the southwest corner of Walnut Boulevard and Continente Avenue, for the portion of costs associated with corner focal point improvements constructed on City property.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with Jeffry Family Partnership, Design Review (DR) No. 04-12, an office building, located at the southwest corner of Walnut Boulevard and Continente Avenue, for the portion of costs associated with corner focal point improvements constructed on City property.

PREVIOUS ACTION
On April 12, 1994, City Council approved Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facility Improvements.

On June 5, 2001, Planning Commission adopted Planning Commission Resolution No. 01-27, which approved DR No. 00-36, for the construction of an office building at the southwest corner of Walnut Boulevard and Continente Avenue.

On July 20, 2004, Planning Commission adopted Planning Commission Resolution No. 04-43, which approved DR No. 04-12, for the construction of phase two of the office complex at the southwest corner of Walnut Boulevard and Continente Avenue.

BACKGROUND
DR No. 04-12 is the second phase of an office complex to be constructed at the southwest corner of Walnut Boulevard and Continente Avenue. The Conditions of Approval for phase one required the Developer to construct enhanced corner focal point improvements at the corner of Walnut Boulevard and Continente Avenue. These improvements were not constructed and were again conditioned on phase two of the project. The Planning Commission added a condition that the portion of the enhanced corner focal point improvements constructed on City property would be fee creditable.

Staff has determined that 60% of the corner focal improvements will be located on City property; therefore, 60%, or $10,200 of the $17,000 construction cost should be fee creditable. Costs for design, plans and coordination are not fee creditable since these costs would have been incurred by the Developer for these improvements as a part of the development.

The City Engineer has reviewed this agreement and the City Attorney has approved as to form.

FISCAL IMPACT
Roadway Facility Fees will be reduced by $10,200.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A REIMBURSEMENT AGREEMENT WITH JEFFRY FAMILY PARTNERSHIP, DR NO. 04-12, FOR THE PORTION OF COSTS ASSOCIATED WITH THE CORNER FOCAL POINT IMPROVEMENTS TO BE CONSTRUCTED ON CITY PROPERTY.


WHEREAS, on April 12, 1994, City Council approved Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facility Improvements; and

WHEREAS, on July 20, 2004, Planning Commission adopted Planning Commission Resolution No. 04-43, which approved DR No. 04-12, for the construction of an office building at the southwest corner of Walnut Boulevard and Continente Avenue and required the Developer to construct enhanced corner focal point improvements, a portion of which are located on City property; and

WHEREAS, certain facility improvements are reimbursable if constructed on City of Brentwood property; and

WHEREAS, the Developer will construct the enhanced corner focal point improvements, which is partially on City property making them eligible for partial reimbursement.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute a Reimbursement Agreement with Jeffry Family Partnership, DR No. 04-12, an office building, located at the southwest corner of Walnut Boulevard and Continente Avenue, for the portion of cost associated with enhanced corner focal point improvements to be partially constructed on City property.
