Subject/Title: Adopt a Resolution approving the Contract Documents and authorizing the City Manager to execute a Construction Contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-3056 to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

RECOMMENDATION
Adopt a Resolution approving the Contract Documents and authorizing the City Manager to execute a Construction Contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-3056 to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

PREVIOUS ACTION
On May 26, 1998, City Council approved an updated Master Agreement, Administering Agency-State Agreement for Federal Aid Projects No. 04-5300.

On June 27, 2000, City Council authorized the City Manager to sign a design contract with Harris & Associates for the design of Walnut Boulevard Widening, CIP Project No. 336-3056, from Balfour Road to Oak Street.

On March 13, 2001, by Resolution No. 2249, City Council authorized the City Manager to execute a Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening, CIP Project No. 336-3056.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Walnut Boulevard Widening, CIP Project No. 336-3056.

BACKGROUND
The City was awarded a grant in the amount of $1,300,000 from the Federal Intermodal Surface Transportation Efficiency Act (ISTEA) program, but due to time constraints it was impossible to meet Federal requirements. The Metropolitan Transportation Commission (MTC) approved the City’s request to transfer $1,110,000 of these funds to the Brentwood Boulevard Widening, CIP Project No. 336-3054 which was constructed in 2004. The City is obligated, per signed agreement with the State of California, to perform the Walnut Boulevard widening work prior to September 2007. This obligation also includes, having Caltrans review and approve all the contract documents prior to advertising the project for bid.

In the process of obtaining the necessary approvals from Caltrans for the Walnut Boulevard Widening contract documents, Caltrans discovered that the utility portion of the improvements were not included in the original grant application filed over five years ago. To modify this application and all the associated project studies to include the utilities as part of the project would cause this project to be delayed another construction season; therefore, at the suggestion of Caltrans staff, the City was advised to split the project into Phase I (utilities) and Phase II (roadway widening). By splitting the project, it allowed the City to finally move forward and only be required to coordinate and comply with Caltrans requirements for Phase II of the project, and use City Standard requirements for Phase I. Furthermore, the utilities portion of the project is not eligible for federal funding reimbursement.

Staff first advertised the project for construction beginning Friday, February 8, 2006 and bids were opened on Friday, March 10, 2006. A total of six (6) bids were received, the bids were reviewed and the lowest responsive, responsible bid was received from K. J. Woods Construction, Inc.

The six (6) bids were:

1. K. J. Woods Construction, Inc. $1,984,000.00
2. Bay Cities Paving & Grading, Inc. $2,223,735.35
3. William G. McCullough Co. $2,672,458.60
4. North Bay Construction, Inc. $3,010,130.00
5. Tennyson Electric, Inc. $3,395,138.00
6. Pacific Underground Construction, Inc. $4,103,830.00

Staff recommends the award of the construction contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-3056 to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency of $198,400, for a total amount of $2,182,400.

FISCAL IMPACT
The funds associated with this work are included in the adopted 2005/06 – 2009/10 Capital Improvement Program and the budget contains funds for the construction of the Walnut Boulevard Widening (Utilities), CIP Project No. 336-3056.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE CONTRACT DOCUMENTS AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT FOR THE WALNUT BOULEVARD WIDENING (UTILITIES), CIP PROJECT NO. 336-3056 TO K. J. WOODS CONSTRUCTION, INC. IN THE AMOUNT OF $1,984,000, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $2,182,400.


WHEREAS, on May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Walnut Boulevard Widening, CIP Project No. 336-3056; and

WHEREAS, the project was advertised beginning, February 8, 2006 and bids were opened on Friday, March 10, 2006; and

WHEREAS, a total of six (6) bids were received and the lowest responsive, responsible bid was received from K. J. Woods Construction, Inc. in the amount of $1,984,000.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the Contract Documents and authorizes the City Manager to execute a Construction Contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-3056 to K. J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.
