RECOMMENDATION
Adopt a Resolution approving and authorizing the Chief of Police to execute a Funding Agreement between the California Office of Traffic Safety and the City of Brentwood in the amount of $202,700 for the Vasco Road Safety, Speed and DUI Joint Education and Enforcement Project and amending the Vasco Road Safety Grant budget for $202,700 in expenditures and $202,700 in revenues.

BACKGROUND
The California Office of Traffic Safety (OTS) makes funds available to local government for the purposes of reducing vehicle, bicycle and pedestrian collisions, and making public roadways safer. An application was submitted to OTS for funding of a joint safety education and enforcement program for Vasco Road. The roadway is primarily (approximately 90%) in the jurisdiction of the Martinez/Contra Costa and the Dublin/Alameda CHP offices. Because this roadway was constructed to replace but not widen an existing two-lane facility, it remains essentially a rural facility which is located in both Contra Costa and Alameda counties. This has created somewhat of a challenge in enforcement for the CHP.

Although CHP has been very responsive to the enforcement needs of Vasco Road, alone they are unable to provide the level of proactive enforcement presence that is needed to have a positive impact on changing aggressive driving behaviors that have led to the majority of serious/fatal collisions. The Vasco Road Safety, Speed and DUI Joint Education and Enforcement Project will augment the CHP with increased enforcement and manpower from both the Brentwood Police Department and the Livermore Police Department. The intent is to alter driver behavior as they enter the Vasco Road corridor by placing highly visible, strategically coordinated traffic enforcement presence on the arterials leading directly to the corridor in both Livermore and Brentwood. The multi-jurisdictional enforcement effort will serve to raise public awareness as well as providing a deterrent to those negligent drivers.

FISCAL IMPACT
The total amount of the award is $202,700. There is no match requirement associated with this grant program. The Office of Traffic Safety grant will fund approximately 750 overtime hours per year, for each agency (Brentwood and Livermore Police Departments). The City of Brentwood will be administering and directing this grant on behalf of both Brentwood and Livermore Police Departments per the terms of this grant.

As this grant was just awarded, there currently is no budget associated with this grant program. The budget for the Police Vasco Road Safety Grant must be amended to reflect the award amount of $202,700 for grant expenditures and $202,700 for the offsetting increase in revenues. There is no impact to the bottom line and this is a one-time budget adjustment.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CHIEF OF POLICE TO EXECUTE THE FUNDING AGREEMENT WITH THE OFFICE OF TRAFFIC SAFETY FOR ALLOCATION OF FUNDS FOR THE VASCO ROAD SAFETY, SPEED AND DUI JOINT EDUCATION AND ENFORCEMENT PROJECT AND AMEND THE VASCO ROAD SAFETY GRANT BUDGET FOR $202,700 IN EXPENDITURES AND $202,700 IN REVENUES

WHEREAS, the Office of Traffic Safety (OTS) administers a federal grant program using federal funds apportioned to California under the National Highway Safety Act and the Transportation Equity Act for the 21st Century (TEA-21) for programs designed to reduce deaths, injuries and economic losses resulting from traffic related collisions; and

WHEREAS, OTS solicits project proposals from each region for this program each winter for implementation beginning in the following Federal fiscal year; and

WHEREAS, based on the concept paper submitted for the Vasco Road Safety, Speed and DUI Joint Education and Enforcement Project, OTS has approved funding for the project in the amount of $202,700 for the period from March 31, 2006 to September 30, 2007; and

WHEREAS, the intent of the Vasco Road Safety, Speed and DUI Joint Education and Enforcement Project is to change aggressive driving behaviors using a proactive enforcement presence on the Vasco Road corridor; and

WHEREAS, a resolution is necessary to approve the funding agreement and authorize the Chief of Police to execute the agreement as the City’s representative.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that

1. Up to $202,700 in OTS grant funding for the period from March 31, 2006 to September 30, 2007 is authorized is accepted and authorized for expenditure.
2. The Chief of Police is designated as the City’s authorized representative to execute the necessary documents for this grant program.
3. This Resolution will be effective upon adoption.
4. The Vasco Road Safety Grant budget is amended for $202,700 in expenditures and $202,700 in revenues.
