Subject/Title: Adopt a Resolution accepting Improvements for Montelena I, Centex Homes Subdivision No. 8469, located north of Apricot Way and west of Fairview Avenue.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Montelena I, Centex Homes Subdivision No. 8469, located north of Apricot Way and west of Fairview Avenue.

PREVIOUS ACTION
On December 4, 2001, by Resolution No. 01-84, Planning Commission approved Tentative Subdivision Map No. 8469, with conditions.

On December 10, 2002, by Resolution No. 2754, City Council approved Final Map Subdivision No. 8469, accepting the improvement securities and approving the Subdivision Improvement Agreement.

On April 8, 2003, by Resolution No. 2827, City Council approved a Reimbursement Agreement with Centex Homes for Master Planned Facility Improvements.

BACKGROUND
This subdivision, located north of Apricot Way and west of Fairview Avenue, has been developed by Centex Homes and contains 137 single-family residential lots. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. As a part of this project, Centex Homes completed the west side widening to Fairview Avenue including landscaped parkway, extended Grant Street west of Fairview Avenue and installed landscaping and a regional trail along the EBMUD Aqueduct adjacent to their project. Centex Homes has provided a Maintenance Bond to cover the twelve-month warranty period for all improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 7,849 LF of 8” sewer lines, 5,933 LF of 8” waterline, 2,198 LF of 12” waterline, 1,359 LF of 20” Master Planned waterline, 6,367 LF of various diameter storm drain, 16,894 LF of 5’ wide sidewalk, 11,957 LF of pavement, 19,450 LF of curb and gutter, 57 streetlights, 9,330 LF of fiber optic conduit and 172,015 SF of landscaping and irrigation.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $80,000 associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-3 has been formed for this subdivision and will be responsible for all street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR MONTELENA I, CENTEX HOMES SUBDIVISION 8469 LOCATED NORTH OF APRICOT WAY AND WEST OF FAIRVIEW AVENUE.

WHEREAS, on December 4, 2001, by Resolution No. 01-84, Planning Commission approved Tentative Subdivision Map No. 8469, with conditions; and

WHEREAS, on December 10, 2002, by Resolution No. 2754, City Council approved Final Map Subdivision No. 8469, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS, on April 8, 2003, by Resolution No. 2827, City Council approved a Reimbursement Agreement with Centex Homes for Master Planned Facility Improvements; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that:

1. The Public improvements are accepted for maintenance and all offers of dedication for rights-of-way, easements and parcels of land intended for public use as shown on the Final Map are hereby accepted;

2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted;

3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution;

4. The City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
