RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute Amendment One to the Design Contract with Mark Thomas and Company Inc., for the Brentwood Boulevard Widening – Central, CIP Project No. 336-3149, in the amount of $33,600, plus a 10% contingency of $3,360 for a total amount of $36,960.

PREVIOUS ACTION
On July 12, 2005, City Council approved the Design Contract with Mark Thomas and Company Inc. for the Brentwood Boulevard Widening – Central, CIP Project No. 336-3149.

BACKGROUND
The Brentwood Boulevard Widening - Central, CIP Project No. 336-3149, will continue the widening of Brentwood Boulevard between Village Drive and Central Boulevard. The project includes two lanes in each direction, with bike lane, curb and gutter, median, sidewalk, street lighting and landscaping. This project will improve traffic flow and provide a smooth progression along Brentwood Boulevard.

The current contract amount for the design and preparation of construction plans and specifications total is $143,718, plus a 10% contingency of $14,371.80 for a total amount of $158,089.80. This project has had some constraints, unforeseen and unanticipated obstacles to overcome during the plan check process for a Caltrans encroachment permit. Staff has attached the proposed scope of services and fees in the amount of $33,600, for the work anticipated to take the project through approval and issuance of a Caltrans encroachment permit.

The additional scope of service includes project redesign, temporary signal design, right-of-way mapping and Storm Water Pollution Prevention Plan (SWPPP) preparation. The original design had a median, which has been redesigned to include a two way left turn lane. The request originated from the adjacent property owners and after an analysis of existing driveway locations staff agreed on the redesign.

The temporary signal design was not contemplated in the original scope of work; however, during the Caltrans plan check process comments were received indicating a temporary signal would be required during the different phases of construction. The initial engineering verification of the project and review of the available information regarding right-of-way mapping was found to be erroneous and incomplete in several locations. The modifications to the scope of service for the mapping were essential in order to verify the existing street right-of-way. The SWPPP is required to conform to current Caltrans standards.
FISCAL IMPACT
The total cost for this contract amendment is $33,600, which brings the total contract amount to $177,318, plus the 10% contingency of $17,731.80 for a total of $195,049.80. The funds for this project are from roadway facility fees, which have been included in the approved 2005/06 – 2009/10 Capital Improvement Program Budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT ONE TO THE DESIGN CONTRACT WITH MARK THOMAS AND COMPANY INC., FOR THE BRENTWOOD BOULEVARD WIDENING - CENTRAL, CIP PROJECT NO. 336-3149, IN THE AMOUNT OF $33,600, PLUS A 10% CONTINGENCY OF $3,360, FOR A TOTAL AMOUNT OF $36,960.

WHEREAS, on May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program, which included the Brentwood Boulevard Widening - Central, CIP Project No. 336-3149; and

WHEREAS, on July 12, 2005, City Council approved the Design Contract with Mark Thomas & Company, Inc. for the Brentwood Boulevard Widening - Central, CIP Project No. 336-3149; and

WHEREAS, the project had some constraints unforeseen and unanticipated obstacles to overcome during the plan check process for a Caltrans encroachment permit.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute Amendment One to the Design Contract with Mark Thomas and Company Inc., for the Brentwood Boulevard Widening - Central, CIP Project No. 336-3149, in the amount of $33,600, plus a 10% contingency of $3,360, for a total amount of $36,960.
