Subject/Title: Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc., for the construction of the O’Hara Loop Realignment (Second Street Extension), CIP Project No. 336-3145.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc., for the construction of the O’Hara Loop Realignment (Second Street Extension), CIP Project No. 336-3145, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On June 10, 2003, by Resolution No. RA-69, the Redevelopment Agency adopted its 2003-2005 Budget, which included $1,000,000 for the O’Hara Loop Realignment project.

On May 25, 2004, City Council approved Resolution No. 2004-113, approving the 2004/05 - 2006/09 Capital Improvement Program (CIP) for the City of Brentwood, which included the O’Hara Loop Realignment, CIP Project No. 336-3145.

On August 10, 2004, City Council approved Resolution No. 2004-196, approving the contract documents and awarding the construction contract for the O’Hara Loop Realignment, CIP Project No. 336-3145, to Bay Cities Paving & Grading, Inc. and amending the CIP Budget Sheet.

BACKGROUND
The completion of Sand Creek Road from the Highway 4 Bypass to Brentwood Boulevard has brought additional traffic destined for downtown onto O’Hara Avenue/Second Street south of Sand Creek Road. To accommodate additional traffic and to improve circulation into the downtown area, it was imperative to complete the missing direct link from O’Hara Avenue to Second Street at Central Boulevard. Now that the new Second Street Extension is completed and in operation, the traffic circulation has improved from the central and northwest areas of Brentwood to downtown and to Liberty High School.

The City of Brentwood advertised the project for construction beginning Thursday, July 15, 2004 and bids were opened on Tuesday, August 3, 2004. Bay Cities Paving & Grading, Inc. was awarded the construction contract and was able to work through the winter months to substantially complete the project and the roadway opened to the public on April 27, 2005.

The contractor has met all the contractual requirements for the City to accept the work and has completed all necessary punch list items. This acceptance by the City Council is an administrative action necessary to formally close the project.

This project included:

• 800 lineal feet of arterial roadway with two travel lanes and a bike lane in each direction, and raised landscaped median.
• 3,700 lineal feet of curb and gutter
• 8,800 square feet of sidewalk
• 15,500 square feet of landscape and irrigation
• 550 lineal feet of masonry wall
• 1,800 square feet of soundwall
• Three twin electrolier street lights
• 315 feet of 18” storm drain
• 650 lineal feet of 8” water line and two fire hydrants
• Traffic signal at Second Street/O’Hara Avenue
• Traffic signal at Central Boulevard/Second Street
• Signal interconnect between two new signals
• 1,200 lineal feet of fiber optic conduit

FISCAL IMPACT
The previously authorized construction contract with Bay Cities Paving & Grading, Inc. provided for the bid amount of $1,524,296.32, plus a 10% contingency for a total amount of $1,676,725.95.

The total project construction cost is $1,671,863.65, which is $4,862.30 less than the total authorized amount with Bay Cities Paving & Grading. Due to necessary additional construction work required, such as masonry wall and construction phasing modifications to minimize impact to existing apartment complex, utility and landscaping modifications, miscellaneous traffic signal modifications to be in compliance with ADA pedestrian crossing, contaminated dirt off-haul, additional paving and signing and striping beyond original limits of the project, approximately 9.5% contingency funds were utilized.

There are sufficient funds in the CIP Construction Budget for the O’Hara Loop Realignment, CIP Project No. 336-3145, to cover the construction cost for this contract and close out this project.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY BAY CITIES PAVING & GRADING, INC. FOR THE O’HARA LOOP REALIGNMENT (SECOND STREET EXTENSION), CIP PROJECT NO. 336-3145, AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on June 10, 2003, by Resolution No. RA-69, the Redevelopment Agency adopted its 2003-2005 Budget, which included $1,000,000 for the O’Hara Loop Realignment project; and

WHEREAS, on May 25, 2004, City Council approved Resolution No. 2004-113, approving the 2004/05 - 2006/09 Capital Improvement Program (CIP) for the City of Brentwood, which included the O’Hara Loop Realignment, CIP Project No. 336-3145; and

WHEREAS, the required public improvements for the O’Hara Loop Realignment (Second Street Extension), CIP Project No. 336-3145, have been completed and are in conformance with contract plans and specifications.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the O’Hara Loop Realignment (Second Street Extension), CIP Project No. 336-3145, is hereby accepted and the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on August 10, 2004, enter into an agreement with Bay Cities Paving & Grading, Inc., for the construction of the O’Hara Loop Realignment, CIP Project No. 336-3145; located at Second Street from Central Boulevard to O’Hara Avenue, Brentwood, California.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete the said project.

On February 14, 2006, the said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
