Subject/Title: Adopt a Resolution approving, and authorizing the City Manager to execute, a Professional Services Agreement with EDAW, Inc., a design, planning and environmental professional firm, to provide a General Plan for John Marsh Home and Cowell Ranch in the amount of $241,500 plus a 20% contingency, for a total amount not to exceed $289,800.

RECOMMENDATION
Adopt a Resolution approving, and authorizing the City Manager to execute, a Professional Services Agreement with EDAW, Inc., a design, planning and environmental professional firm to provide a General Plan for John Marsh Home and Cowell Ranch in the amount of $241,500 plus a 20% contingency, for a total amount not to exceed $289,800.

PREVIOUS ACTION
On December 13, 2005, City Council approved and authorized the City Manager to execute a Grant Agreement between the City of Brentwood and the California Cultural and Historical Endowment (CCHE) for the John Marsh Rehabilitation Project, CIP 352-5234 and revising the CIP 352-5234 project sheet accordingly.

BACKGROUND
In the fall of 2004, the City prepared a grant application to the California Cultural and Historical Endowment (CCHE). In December 2004, City staff made presentation to the CCHE for a requested $4,000,000 grant amount. The City received a grant in the amount of $819,239. Included in the CCHE grant was completion of a General Plan for the John Marsh Home and Cowell Ranch.

In September 2005, City Council approved a Memorandum of Understanding with the California Department of Parks & Recreation establishing the framework of development, restoration and maintenance of John Marsh Home and Cowell Ranch.

At the request of State Parks in November 2005, the City of Brentwood issued 32 Requests for Proposal (RFP) for a consultant to complete the General Plan study with a response deadline of December 9, 2004. The City received two qualified proposals; one from EDAW, Inc. and one from MIG (Moore Iacofano Goltsman, Inc.)

On December 16, 2005, the City of Brentwood staff met with The California State Department of Parks & Recreation staff to evaluation the RFP responses and decide which consultant to use on the John Marsh Home and Cowell Ranch General Plan study. Based upon the RFP responses received, the City staff and California State Department of Parks & Recreation staff are recommending EDAW, Inc. of San Francisco, California be selected to prepare the General Plan study.
The agreement presented to City Council is the accumulation of all previous work completed to date by all parties involved.

FISCAL IMPACT
The funds for the John Marsh Home and Cowell Ranch General Plan have been paid to the City by the developer of the Vineyards project and are contained within CIP Project #352-5234.

City staff will monitor and approve payment requests from the consultant upon proper documentation and approval from the California State Department of Parks & Recreation Diablo Vista District.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE, A PROFESSIONAL SERVICES AGREEMENT WITH EDAW, INC., A DESIGN, PLANNING & ENVIRONMENTAL PROFESSIONAL FIRM, TO PROVIDE A GENERAL PLAN FOR JOHN MARSH HOME AND COWELL RANCH IN THE AMOUNT OF $241,500 PLUS 20% CONTINGENCY, FOR A TOTAL AMOUNT NOT TO EXCEED $289,800.

WHEREAS, the State of California Parks and Recreation Department requires a professional firm to prepare a General Plan for the John Marsh Home and Cowell Ranch; and

WHEREAS, at the request of the State of California Parks and Recreation Department, the City of Brentwood has agreed to facilitate the selection of a consultant; and

WHEREAS, staff is satisfied with the proposal presented by EDAW, Inc. for the preparation of a General Plan; and

WHEREAS, the developer of the Vineyards at Marsh Creek has deposited sufficient funds with the City to pay for completion of the General Plan study; and

WHEREAS, the City Council of the City of Brentwood authorized the City Manager to enter into an agreement with EDAW, Inc., a design, planning and environmental professional firm, to provide a General Plan for John Marsh House and Cowell Ranch; and

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood hereby approves, and authorizes the City Manager to execute, a professional services agreement with EDAW, Inc., a design, planning & environmental professional firm, to provide a general plan for John Marsh Home and Cowell Ranch in the amount of $241,500 plus a 20% contingency, for a total amount not to exceed $289,800.
