Subject/Title: Set the date for the appeal of denial of Conditional Use Permit No. 05-22 (Living Water Ministries Residential Home).

Set January 24, 2006, as the public hearing date to consider the appeal by Living Water Ministries Residential Home of the denial of Conditional Use Permit No. 05-22.

On December 6, 2005, the Planning Commission held a public hearing to consider a Conditional Use Permit No. 05-22 for Living Water Ministries Residential Home to operate a group home for up to 14 residents located at 109 Fahmy Street. The Commission voted 4-1 (Padgett – no) to deny the requested conditional use permit (Resolution No. 05-85).

By the attached letter submitted December 16, 2005, as required by Section 17.880.003.D of the Zoning Ordinance, Living Water Ministries Residential Home submitted a written statement as reason for the appeal of the Planning Commission’s decision. Per Sections 17.880.002 and 003.B and E (Appeal Procedure and Set Hearing), the applicant's appeal letter is being forwarded to the City Council. It is recommended that the City Council set January 24, 2006 as the date for the public hearing on the appeal request.

There will be no fiscal impact.
